Civil surgeon said I need to undergo another medical exam?!?

Ok here's what happened earlier.

I called one of the civil surgeon designated by USCIS (Dr. Dan Azar, Access OmniCare, 39180 Farwell Drive, Suite 231, Freemont, CA 94538) to get an appointment. I spoke with the receptionist and explained her that I need to get an appointment with Dr. Dan Azar to transcribe my vaccination into I-693 Form. She said their available date is March 10th at 3:30pm, so I agreed (it will be on next week). When I asked her how much it will cost me, she said its $120.00 for exam. Hmmmmm... what??!!! (I said to myself,hehehe)... I told her I don't need to redo my medical exam, I just need someone to transcribe my vaccination because I just had my med exam in St. Lukes on November 17th, 2014. The lady transfer me to another person (she said she's the manager) and she asked me why do I need an appointment. I explained to her that I am a K1 visa holder, I already had my medical exam and vaccination in the Philippines and I have the written documentation with me and I would like a get an appointment with the civil surgeon to transcribe my vaccination into I-693 form for my adjustment of status. She said it will cost you $120.00 because you need to undergo medical exam................... I ended up cancelling my appointment with them :(

For me, $120.00 is still $120.00. I don't want my husband to spend money AGAIN for medical exam. We paid alot of money for my visa/med exam, and now for my adjustment of status.

Anyone here has the same problem getting a civil surgeon who is knowledgeable in K-1/DS-3025? And anyone here knows a civil surgeon who can fill up my I-693 form without full medicals and with cheaper fee?

By the way, I'm in Fremont, CA.

Back when I did mine I just rang around and ended up getting it done for free, now my understanding is that it is no longer required.

Civil-surgeons wanting to give K-1s a new medical exam is a common problem that many seem to not be educated about. If you are certain that you do not need another medical exam then just keep calling civil-surgeons on the list until you find one that will do what you want.

I struggled to understand this part of the process when I went through it.

I did NOT have another medical exam, because I had just had one & everything was completed properly.

Section III Frequently Asked Questions
3. What if I am a K non-immigrant visa holder and already had a medical exam overseas?
If you were admitted as
a: K-1 fiancé(e) or a K-2 child of a K-1 fiancé(e); or as a
b.K-3 spouse of a U.S. citizen or a K-4 child of a K-3 spouse of a U.S. citizen; and
c.You received a medical examination prior to admission, then:
(1)You are not required to have another medical examination as long as your Form I-485 is filed within one year of
your overseas medical examination, and the medical examination did not reveal a Class A medical condition, or
if you did have a Class A medical condition, you received a waiver of inadmissibility and have complied with
the terms and conditions on the waiver.
(2)Even if a new medical examination is not required, you must still show proof that you complied with the
vaccination requirements.
If the vaccination record (DS 3025) was not properly completed and included as part
of the original overseas medical examination report, you will have to have the vaccination report completed by
a designated civil surgeon. In this case, you are required to submit the vaccination record and page 1 of Form

I-693.

Save your money. Follow these directions.

You do not need the medical exam tests repeated. If your medical was done within a year of filing for AOS (which your's has), that is all you need. No exam or partial tests to do.

Psst! Don't need to have the vaccination record transcribed to the I-693. Read the instructions for the I-485, page 4, section 7c : Only need to include a copy of your vaccination record (DS-3025) with the I-485 for AOS. (and I suggest you make a copy of page 4 of the instructions and highlight section 7c and staple it to the copy of the vaccination record, some adjudicators are not all that well educated)

Yes, that's what I thought that I don't need to repeat my med exam and I know that I don't need to pay so much money just to transcribe my vaccination.

Psst! Don't need to have the vaccination record transcribed to the I-693. Read the instructions for the I-485, page 4, section 7c : Only need to include a copy of your vaccination record (DS-3025) with the I-485 for AOS. (and I suggest you make a copy of page 4 of the instructions and highlight section 7c and staple it to the copy of the vaccination record, some adjudicators are not all that well educated)

On my DS-3025, the Varicella vaccine was labeled as D (not routinely available), so I guess I need to submit I-693 Form along with my I-485. Am i right?!! I'm so confused.

I never had. Also, I did a blood test with my health provider and the result for varicella was Negative :(

Hi..got my vaccines transcribe by Dr. Jhin Lin in fremont also for $50.. at first when I called for an appointment, the secretary said they will charge $120 for skin test and etc..when I get there I just explained that my medicals in the Phils.are still valid and all I want is for them to transcribe my vaccines in I-693 form..they gave me additional flu shot to complete my record for another $20 and handed me a sealed envelope..that's it and we're done..I did it with my K2 also..

Timeline

1) Yes, many doctors are in business to make money, and it's a borderline scam...

or at least its unethical to force medical exam again when you don't need one.

2) That said, I assume you are doing this in preparation for AOS (green card),

EAD (work permit), and AP (travel authorization) packet that you want to sent off?

If so, not everyone needs one. And yes, I agree $120 is $120. Money doesn't grow on the tree.

Your DS-3025 was included in the packet that you turned in at POE,

and it's supposed to make its way back to USCIS and get filed with your case.

So if the DS-3025 was filled out correctly and completely (and they usually are),

and if it successfully make it back to the USCIS, you do not need to worry

about I-693 (and another medical exam).

3) I would just file the packet without (like me) and only if you get RFE for it,

then go get I-693 transcribed. Also, if you call around, sometimes there are some

civil surgeons that will do the I-693 transcribing without requiring medical exam.
