K1 expired fiance returned home. Question about travel.

Hello, about a year ago me and my fiancé successfully received our K1 Visa. She traveled to the U.S. and because of circumstances that I'd rather not mention she had to return back before the 90 days was up. So obviously I know that we will need to do another K1 or try another route if we choose. However, before she had the K1 she had a 10 year visitor visa and had visited on several occasions. They didn't void it out or stamp it when she came in the country. Can she still visit using the Visitor Visa or was it voided through the system when she received the K1?

No one can answer you with 100% guarantee.

It is up to those that review her application and even then it is up to the border if they let her in or not.

she did "use" the K1 visa when she entered the U.S., and she properly left the country within the 90 day time frame as is required without getting married, I would hope and I believe that it should have no influence over her application for a tourist visa .

I'd say that there's no harm in trying, but realize that you may the $160 application fee and whatever time it takes for her to travel for the interview. However, because she had a visitor's visa before, no overstays, and the K1, she may have a better chance than most foreign fiances from non-VWP countries. Personally, I'd try in your shoes unless traveling to the consulate could result in negative consequences for your fiance (like losing a job for taking a few days off for travel).

Their only concern about granting visitor visa is having strong ties in us which your fiance already have.

About tourist visa , it is definately cancelled in their system.

You can try the tourist visa else you can go for another k1

I had a tourist visa and then was there on conditional green card which i could not get renewed because i had to return home because of some issues.

I applied for a tourist visa and was not granted so my wife had to file i130 again for me this september

As soon as she entered on the K-1, all other visas were cancelled as they are unnecessary at that point, as a K-1 allows for AoS to become an LPR and eventually a US Citizen, as well as eligible for AP.

Right, but she left the country before even marrying, forget AOS, which was a pretty terrible idea but sometimes things can't be helped. So the B2 was (more than likely) cancelled and the K1 is now void (it's a single use visa).

B-2 is void. K-1 is void.

The only option is to apply and be granted another visa.
