The reason I was denied was because I just arrived back from America, my fiancee's mother had a stroke as I was on the plane. When I told the interviewer I wanted to be there for moral support, this along with the fact my fiancee was sponsoring me, the interviewer believed I was going to be a live in carer for my fiancee's mother and getting paid for it. Sure the mother doesn't even live with my Fiancee. Tried to explain but the interviewer had little interest.

I just don't want it to look like because we couldn't get the B2 were trying for the K1. Don't want to give them any reasons they don't need, lol.

I was worried about this same thing, and while I'm not finished with the process yet, I have been assured by many folks here, and even a State Department liaison that this would not be the case. Maybe if you'd applied from a "high risk" country (which yours most certainly isn't) in January for a B2, and denied, then applied in February for a K1, for someone you'd just met in December with little evidence of a real relationship....ok, maybe that's a red flag (that could look like a scam of some sort).

For you, and basically most of the rest of us, it'll look like what it is...that you wanted to visit your girlfriend/fiance and they said no. Circumstances in your life changed and now you're looking not to visit but to live...hence the K1. We went for a B2 so that he could visit me here even though we knew that there was basically zero shot at getting one. We had many reasons for doing this, the largest of which is that I was not 100% comfortable with basically asking him to make a really huge decision without having all the information available---ie, never having visited the US. Again, total outside chance but we figured that it was better to try than to not try so that down the road if things get rocky, we'll always know that we did our best to be responsible and fair in making this commitment and that really it's just the government that got in the way. If for any reason this comes up in his (and your) K1 interview, just explain it. But I doubt it'll even be a blip.

Marriage/ AOS Timeline:

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED  (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding!

Thank you for the reassurance, I was very worried about that. Firstly good luck in your progress, I do wish it works out well :). Secondly may I ask, how far are you into your process. My Fiancee and I will be sending ours off in about two weeks - three weeks time.

Being denied a tourist visa because they believe you had immigrant intent had no impact on getting a K-1 visa. The K-1 visa has immigrant intent, so having immigrant intent is not a reason to deny a K-1.

If you were denied B2 multiple times, it wont affect your K1 application whatsoever! They surely can deny you for asking to visit the US but, def cant deny you to join your family unless if you have a criminal record!

There's no reason of k1 denial due to b2 denial. You didn't hid your intent to visit your girlfriend and that was your reason when you applied for one. :)

For the evidences I guess what I read from your statements, you've got enough. Just don't forget to include your board passes and passport copy of entry/exit passes. That is one if the most relevant evidence that they are looking for too.

If you've got family pictures together, make sure to include that too! Even photos with friends. As what I've learned from here it's what is important too.

Well as what you've told everything ready to be sent today, let's hope everything goes smooth and good luck!

Hi, the only thing I can share u is about the b2 denial.. I did apply last year 2x and both were denied. when I went to my interview few weeks ago, feb 11', 2015 to be exact.. They brought up the question about my b2 application, the first (Filipino consul) said, 'oh so u applied for a b2 visa'? I honestly told her yes ma'am I did, 2x and got denied. So I didn't know that she put a lil note (yellow sticky note) on my application, so when I got interviewed by the American consul, he saw the note on my application.. He then again asked me the same question, and I gave him the same answer, I thought I was gonna be denied coz it took him a while and told me that he will just have to check something on the computer about my b2 visa application, well anyway to cut it short.. He smiled at me and said 'ok your visa is approved' ... So all I wanted to say is relax, ur b2 visa denial will not affect ur k1 visa application (not unless u told them lies) when u were applying for the b2 visa.. So just be HOnEST I'm telling you they would know if ur lying. Good luck with ur journey :) i know how it feels been there.. But it's a fun journey, just enjoy the ride :)) goodluck

Same thing here. B2 visa denied twice and at the US embassy they asked me if I was denied a visa in the past, I said 'yes' and they said 'Oh yes I see your B2 denied, thats ok, your K1 is approved!'

Be honest!

Good luck!

Thank you very much.

I have the boarding passes from the return flight only. The first trip I lost them and the ones on the way out there, I'm not sure if I still have them over in America, will ask. My passport, I lost it :( I'm hoping to find it before I go to the interview or will request a new one. Hopefully that's okay?

Well just give what you currently has with you. If there will be an RFE then all you needed is to explain why you don't have it anymore. But it will be best if you can find your passport just in case they will insist you to provide one. You may include your itenerary in case you can't find your boarding passes. Your luggage tags can be an evidence along with your itenerary as what I believe there's a code included. But anyway let's hope all the evidences you provided is enough for them to be convinced that you actually seen her lately. Good Luck again! ;)

I will be including the itinerary for both visits anyway. I never thought of the luggage tags. I'll add them also.

Question with regards to address. On the cover note or letter of intent for marriage, I'm trying to figure out what address to use.

Is it the lockbox I'll be sending the application to or local office?

So is it

United States Department of Homeland Security

U.S. Citizenship and Immigration Services

P.O. Box 660151, Dallas, TX 75266

Or

United States Department of Homeland Security

U.S. Citizenship and Immigration Services

4475 South Coach Drive, Tucson, AZ 85714

Thanks :)
