I need help please on what to do next.... My husband went to the embassy to try and get a visiting visa to come and see my father who is dying from terminal lung cancer. We have not started his permanent spousal visa yet due to all my money has had to go to helping with my father's expenses. When he went to the embassy they denied him because they said I should just file the permanent paperwork but that he could reapply for a visiting visa again at any time... I need help because I don't know what to do anymore. Should we reapply for the visiting visa and hold off on the permanent visa? Should we try it another way? Please someone help me!! Even when my husband went he had a letter from my father's doctor with the hospital letterhead that stated what was going on and still a denial...

He has a wife in the US and probably no grand ties to his home country, you're going to have a mighty hard time getting a visitors visa.

Better to get started on the spousal visa.

What country is he in? Regardless of letter from doctor he still has to show ties to his county and every reason why he would return. You have no petition even filed which makes you filing an Adjustment of Status too much a risk.

Best to use that letter to file your I-130 petition and request an expedite on medical reason and see how t goes. You might get it. Than you would do the same at the NVC level also.

Ok thanks, He has a job that he has been at for 9 years and a son that we thought would show he has reason to come back. He even had a letter from his employer. He is in Jamaica. I'm starting on the spousal visa next week.


Our concern was that he wouldn't get here in time to see my father before he passes.

Hi,

Unfortunately, he will have to wait for an immigration visa.

The US Embassy probably thinks that he is trying to immigrate on the tourist visa.

You don't have $420 to file the I-130 but there was $160 for an visitor visa application and money for round trip plane tickets?

It is true that he can re apply as often as he likes, and can be refused as often as he applies.

Always say no harm applying but if the application fee is an issue then that changes.

How well does he know your father, sounds like he has not met him in the US?

He has never met my father because he has never been to the states before. He wants to try one more time for the visiting visa before I file for the spousal visa just so he can come and support me and see my father.

Applying for another visitor visa so soon will unfortunately most likely have the same result, a denial. I would send the I-130 petition and request an expedite. Make sure to send a copy of the letter from your dad's doctor with a letter requesting expedite on medical grounds. I'm sorry to hear about your dad and best of luck.

Unfortunately he wont be granted a tourist visa at all because he has very strong ties in us, and that makes the chances of him adjusting his status very high. The only bad thing is the visa officers are not concerned with the emotions of anyone , all they have to do is to scrutinise the people who they think will not come back to their respective country after once reaching us.

So here the best is to start with the i130 because the road is long enough

Jamaica is a hard one. My husband has had his job for several years, has no problem with money, has a son.....you would think that would be enough to return, but no. My husband was denied his visitor's visa too. Best to start with the spousal visa! If you need any help, feel free to message me!
