Restriction Order? Apply for VAWA as a Man? [split topic]

hi,i"m reading this topic for a few weeks now and i understand that i'm not the only one in a difficult situation.Since i got married my life became a nightmare,i don't even remember how many pills i toked to calm my depression.My wife has a bad behavior because drugs and alcohol .

I loved her and tried to help and convince her to go to rehab but she gotten even more aggressive every time we wore talking about this.I don't want to talk more details about this,but I realized this life is not for me and I don't deserve it.After this all the problems started,she started to spent all my money savings and after 2 weeks being gone for work she changed all the lock doors and basically kicked out from my own apartment,and now i leave at friends houses sleeping on couches and plus she filled an order of protection against me because she is afraid of my reactions.After calling me and texting me over and over with no answer she decided to damage my car,when she is on drugs and alcohol she calls my family and lies to them about me,my mom 2 weeks ago had a hard attack because she believed her lies.Now she is threatening me with calling immigration if i dont come back to her.I did the police report showing that she is calling and texting me after she filled the restriction order,and my question to you is :can i get a restriction order against her or can i apply to VAWA as a man,i hope somebody can help me .Thank you !

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Man can file Vawa,but reading what you said I don't see any abuse against you, there is a huge difference between someone experiencing abuse and someone that have a bad marriage . USCIS through Vawa unit gave hundreds of decisions in Vawa cases stating alcoholism and the use of drugs is not considered abuse . Abuse is a pattern of control humiliation,degradation,isolation,coercion etc. .

TO prove mental abuse you need to attend therapy and have a diagnosis of major depression and/or post traumatic disorder due the abuse suffered. Having a police report stating she contacted you after she filed the restraining order is not sufficient to have a Vawa case approved .

I personally don't see VAWA either I'm sorry. It would be hard to prove that she caused your mother's heart attack. I'm sorry that this is happening to you but that claim is possibly frivolous. It may be best to return home.

A country of Immigrants, that hates new Immigrants... Maybe if education was a right and NOT a luxury, it would be different.

No one here is pretending to be a lawyer. people on here are only giving their opion base on what the facts are, that the op has posted. After reading his post I too agree that is does not sound much like abuse. It sounds more like a bad marriage where both parties have their faults, but if the op wants to spends his money on a lawyer only to hear the lawyer say sorry I did the best I could, then that is his money to waste.

But part of what makes this forum work is in fact people sharing their opinions. sandranj's just happens to be a bit more educated.

that is good but unless the op has more stuff to share you do not have to be that educated to see there is no abuse. I am sure however for a price a lawyer could research and find loop holes and anything else that can help the op ,unless you plan on helping him for free

How am I attacking other members? Can a lawyer give an initial consultation based on a forum post? About which I am sure the OP has privacy concerns and doesn't share everything?

There is no doubt Sandra helps people (I cannot vouch for her lawyer status),but basing a diagnosis of a case and most importantly, someone's life on mere forum post is ridiculous.

I would have thought at least a consultation would be in order, who knows what more there is and what a good lawyer can put together.

The important thing is he is out of the abusive situation.
