I'm trying to withdraw an I-864 as soon as possible (long story, in another thread) and am finding the process infuriating. I called up USCIS and a nice man over the phone assured me all would be well and gave this address to send to:

USCIS

Texas Service Center

4141 St. Augustine Rd.

Dallas, TX 75277

I sent three certified copies here and to other addresses in Vermont, Chicago and Missouri just to be safe. All the ones to Texas were returned. It looks like he gave me the wrong zip code? (75227). I don't really understand why the letters were returned and not just sent on to the right one. I also don't know what address they are supposed to go to. Even a lawyer I spoke with could not tell if they should go to Texas, Vermont etc.

In addition, I made an appointment with Infopass at the counter, they were no help. They could not tell me either or record me having withdrawn the I-864.

Even worse, they said I will never know if it was officially withdrawn or not. That the government does even LET YOU KNOW. Is this really possible?

At this point, I am at a complete loss. Where do I sent the letter withdrawing the I-864. I will send it to as many places as needed but the whole system is so confusing I have no idea!

What's the service center listed on the NOA1 you got for the I-485? Send it to that address certified and hand in a copy at your local office. There should actually be an officer at the local office who deals specifically with fraud cases, so I would try and hand it to them if at all possible.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Yeah that is unclear as she took all the paperwork with her. I went through Infopass to the local office and no one could help me accept anything they said. Is it true that there is no confirmation that an I-865 is withdrawn. In other words, you will never know if it has or hasnt?

ok - I took a look. apologies - I not outline the steps needed to withdraw the I-864 in yer prior topic. I usually list the steps when I bounce into one of these topics, but I didn't in yours. Sorry. Here I go !

Unfortunately, there's really no one set path to withdraw the I-864. USCIS seems stressed at most intake points, so to be successful, you have to initiate a shotgun-approach in withdrawing the I-864.

Common Things:
1. Letter requesting the withdrawal, include a photocopy of the NOA-1, formletter I-797-C receipt notice.
2. Custom formletter with SASE (your address as recipient) with blanks for 'withdrawn date', 'IO NAME', 'IO Signature'

Where to send the letter, via registered mail, hand signature required:
1. Address listed in the NOA-1, receipt notice on the I-485 receipt #.
2. TSC intake address

Walk-in to the Infopass appointment (get a new one, yes sir!)
1. ask for the shift supervisor.
2. tell the shift supervisor that you are withdrawing the I-864.
3. ask the shift supervisor to bring down the AOS Adjudication Supervisor from somewhere inside the buidling.
4. Give over the withdrawal letter to this AOS Adjudication Supervisor. Ask for immediate logging into the CRIS system,
5. Give a hand-receipt notice to this AOS Adjudication Supervisor, fill in name and badge number, get signature, put in date and time, have shift supervisor witness the signature of the AOS Adjudication Supervisor.

The AOS Adjudication Supervisor has God-rights in the computer system, and can instantly tag the electronic casefile as having the I-864 withdrawn.

Thanks for your help. I had a huge file with everything carefully sorted. Unfortunately, she took it during the breakup. I have her A#, her social security number and that's about it. So unfortunately most of those addresses, receipt #s etc etc, I have no clue what they are. Isn't there an easier way to simply withdraw the thing. Doesn't seem like it should be so difficult. I guess it's the Infopass thing...I can try again but they didn't seem to have any clue, I didn't see any supervisors there and they certainly didn't mention any. They just said to send it to Dallas as I have done.

I am requesting the official withdrawal of my Affidavit of Support form I-864. The receipt number for the pending I-485 case is xxxxx The reason for this withdrawal is our separation and pending divorce.

The applicant's name (for the I-485 case):xxxxxx

Date of Birth:xxxxx

Original Petitioner's name (for the I-129f) xxxx

Date of Birth: xxxx

Her A-number A# xxxxx

Her Social Security # is xxxx

I respectfully request a confirmation that my support has been withdrawn.

People at the window counters at yer local office are typically clueless on most things.

And, yer asking for something outside of their pay-grade, as well.

Seems InfoPass will be the route for you, soonish.

You need to send it to the address on your NOA1. You should get a confirmation letter within 10 days after you mail it.

Divorce and separation are not sufficient reason to release from your obligation to support your spouse. Does your spouse already have a green card?
