Hi Pianist27..we got same RFE! G325 is and old form and that's what we gave them for the petitioner which was an honest mistake we never noticed. RFE required us to submit the G325A form too. I had searched several answers to my confusions on the both forms. Most common answers are they are same forms, but old and new. Currently G325a is being used. Have you submitted a new G325A form with your RFE? Or did u submit same G325 forms maybe? so they can just deny the application with just minimal mistakes. They could have issued you another RFE instead. But, it all depends on the hands doing you case. We got approved after 5days of giving them what they need. Im sorry I fully understand how you feel right now.

On October 10th, I was sent an RFE to submit "properly filed out and signed G325As" my myself and the beneficiary. There was no indication what was wrong with the original G325As which I submitted, but after reading them over and over again, I found two errors:

1) In the "form is submitted in connection with an application for" section, we wrote "K-1 Visa" rather than "I-129F" - that doesn't seem serious, but I can see a strict adjudicator not liking it.

2) In the bottom box which asks for family name, first name, middle name, we accidentally wrote my fiance's name in Cyrillic letters.

I corrected these two mistakes and sent in these new G325As. They received them on October 10th.

My denial letter, which I just received, states the following:

"The petitioner responded to our request on October 30th, and submitted an additional copy of the Form G325 already submitted for the petitioner and the beneficiary. However, he did not submit the required Form(s) G-325A as requested.

The petitioner has not complied with the instructions on the forms by submitting the required evidence. Therefore, the petition is denied."

I note their lack of consistency - is it a G325A or G325 form?

The appeal process appears to cost $630. This is quite obviously their mistake, I'm going to refrain from some editorializing about the irony of them insisting on absolute accuracy when they don't seem to pay attention to details either.

Suggestions? Refile? Have a good lawyer look over the application first? At last check, my state still goes through CSC, which is moving relatively quickly, I have to think refiling is not only cheaper, but faster.

4 vs 2? From the I-129F instructions:

Submit two completed and signed Forms G-325A, Biographic Information; one for you and one for your

beneficiary. Except for name and signature, you do not have to repeat the information given on your Form I-129

G325 is an old form in the past, only it is 4 copies long carbonless. G325A is the NEW revised form of G325, shorten into 2 copies long only. Same content and information. The only difference with this form you see online now, is the 'A'. That's why we made a mistake too, you cant tell the difference.

No, it is not 4, just one form each and that makes 2.

No they mean four pages not four forms.

Two forms which are four pages.

Form + instructions x 2

Where as now it's just one page (the form) so just two pages.

Edit: just to clear up because this seems to be confusing all of you.

The G325 and G325A used to be different because one had more pages than the other.

That was the main difference in the forms and why one has the A.

This is a FACT.

Now I've looked and some of you have and are giving conflicting answers about these forms.

The main difference now is that some have a couple words different like how one is 1 or that in the employment second the g325a has 5 bars and the other has 4.

There is NO main difference now.

But a K1 asks for the G325A.

If you get away with a g325 it's not big deal, but it is incorrect.

Just use a G325A because you could have a problem and an RFE like the OP has which was just a genuine silly mistake and I see no problem in their future petition.

Answer=G325A

Can a mod please close this topic as the ops question has been answered.

If I was you, I would just stop and get an Attorney so what if you pay a few thousand dollars its worth it in the end, we wish we had started our case with an Attorney we have one now.

Thank You

So what if it's a few thousand dollars?

Is that a joke?

Filling a k1 (unless it's a difficult case) is not hard.

Advising someone who accidentally sent a form in because one has an A and one doesn't to pay that much for an attorney is ridiculous.

They do not need one nor should you be paying that much at all to file.

G325 is an old form in the past, only it is 4 copies long carbonless. G325A is the NEW revised form of G325, shorten into 2 copies long only. Same content and information. The only difference with this form you see online now, is the 'A'. That's why we made a mistake too, you cant tell the difference.

The G-325A is not the 'new' version of the G-325. They are different forms. One is not simply the updated version of the other. If you go to the USCIS site, you will see there are even more choices, as there is a G-325, G-325A, G-325B, and a G-325C > http://www.uscis.gov/forms

All of the forms were updated at the same time in 2013 > http://www.uscis.gov/forms/forms-updates/update-forms-g-325-g-325a-g-325b-and-g-325c

The G-325A is the correct form to use because that is what the I-129F form instructions ask for on Page 6 >

8. What Other Documents Do You Need?

a. Submit two completed and signed Forms G-325A, Biographic Information; one for you and one for your

beneficiary. Except for name and signature, you do not have to repeat the information given on your Form I-129F.

Years ago, the G-325A had 4 pages with carbon. You had to send all 4 page copies for each person. At that time, the G-325 was 2 pages. This has not been the case for a long time now, and is not even relevant to the situation now. The G-325A was updated to a single page form back on 7/15/09 with a form edition date of 6/12/09. If you check the G-325A example form here on VJ, you will see it is the edition dated 6/12/09. The form has not really changed since, even with the update in 2013.

You only need one G-325A form for each person, the petitioner and foreign fiance(e). No need to send a copy of the instructions page, just the form page itself. You just need to make sure to download and use the G-325A, for the I-129F petition and later for AOS with the I-485.

Wow, an F4 denial is nothing to be sniffed at, don't those visas take about 20 years from start to finish? Glad you got that sorted!

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".
