What's the husband's status? Born in the US USC or naturalized USC? Asking because you say he doesn't even have a passport...

Not sure what the impact of where the husband is born is, He is a USC and his child is entitled to Citizenship. We are looking for the best path to get the child's US Citizenship documented domestically while allowing the mother is allowed to immigrate, preferably while keeping the family together in the US.

The content available on a site dedicated to bringing folks to America should not be promoting racial discord, euro-supremacy, discrimination based on religion , exclusion of groups from immigration based on where they were born, disenfranchisement of voters rights based on how they might vote.

There is no reason now that she is in the USA that she cannot adjust her status. As long as she didn't intend to immigrate and lie to the CBP about her intentions, she can AOS. It is a more expensive

What bearing does having a passport have? Many, many Americans don't have a passport.

Child is a US citizen, but if father's residency cannot be proven than worse case scenario get a Green Card for the child, too. When the mother eventually gets citizenship, the child will automatically become a citizen ( as long as the child is still under 18 years old at that point). Please stop the scare tactics, plenty of people adjust from VWP, it is perfectly legal, as long as there was no immigrant intent at POE. No need for lawyers, either.

I am a bit lost, this women's husband either is or is not a US Citizen. What proof of residency is needed?

We have a back ground of living together in the US for like 4 years and we've been together for 9 years all together.

Just out of curiosity, what visa did you use to live in the US for 4 years?

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

Okay you guys thank you for the comments and help!

We went to the Catholic organization and they told me it's perfectly legal for me to adjust status and for my daughter she should get her passport here or get N-600 filed.
