My stepson's CR-1 is going to expire

Ok so here's my situation: My wife and stepson are from Panama. Both of them have already completed their interviews and received their CR-1 visas, in fact, my wife has her green card already. However, we have been unable to bring my stepson to the country on time as we expected because his birth father dropped a child custody case on us at the last second. The courts have been slow and it's still not complete. Now my stepson's visa is going to expire (on Nov 28) because he hasn't used it within the 6 month period. Does anyone have any experience or knowledge about what to do next? Do I have to start all the way over with the I-130 even though its been done before? I was hoping there was a loophole where we could just start from the NVC part instead, but I haven't been able to find any info stating one or the other. Thanks in advance for any responses.

You may be able to get the visa re-issued and thus valid for another 6 months, as you have clear and documented reasons why he could not travel.

Your stepson will likely need a new medical done. Contact the embassy asap, usually they only re-issue a visa when the first one is not yet expired.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
