Can we start K1 if my fiancé is 17

My fiancé is now 17, can i start the paper work now and based on what I've seen the process might take a year. So by the time she comes here she will be 18 and of legal age to marry? or do i have to wait fro her to turn 18 first?

First, you can started the process now and included parent of consent of hers if she is still minor according to the law of state where you will married her. Someone had done here before and no problem whatsoever. Secondly, please update your timeline so others can help you correctly. Thank you!

Someone had done on Visa Journey before. His fiancée was 17-year-old from Brazil and he included parental consent from her parents. They got approved for the petition. Try to search here and you can find a bunch of threads have had discussed about marrying under 18-year-old fiancé(e)s.

That's why I asked you to fill your timeline in so others can help you for instance which states do you live in, which country she's from, etc. Those information are very important to help you.

Timeline

You both must be free and legally able to marry at the time you file in the state in which you plan to marry. So, if parental consent is needed for a 17 year old to marry in your state, then you will need to include parental consent with your petition. Don't forget to include the proof of meeting within the last 2 years as well.

Either do what everyone is suggesting or wait until she is 18 +

You don't give parental consent as you aren't her father. You will need parental consent from her parents, signed & dated and then add this in with your packet when you are ready to send it off.

Or you can just wait until she's 18

Well you can see the confusion I had when you wrote "So I fill a parental consent".

You should just be able to write it out and attach it with your packet as normally both parties need to be over 18years of age and legally able to marry.

Understandably so, however you need to be sure you do everything by the book or you risk an RFE which will delay things, or even worse a denial.

If you fill out your time, we can help you with any issues she may have in her country. Everyone consulate is different, and some countries are more stringent than others.

We can help you better prepare your packet if we know what country she is from, and what your state is, as well as if this is a same-sex union.

In order to be eligible for a K1 visa you need to meet the following requirements:

If you petition for a fiancé(e) visa, you must show that:

  • You (the petitioner) are a U.S. citizen.
  • You intend to marry within 90 days of your fiancé(e) entering the United States.
  • You and your fiancé(e) are both free to marry and any previous marriages must have been legally terminated by divorce, death, or annulment.
  • You met each other, in person, at least once within 2 years of filing your petition. There are two exceptions that require a waiver:

    1. If the requirement to meet would violate strict and long-established customs of your or your fiancé(e)’s foreign culture or social practice.

    2. If you prove that the requirement to meet would result in extreme hardship to you.

Notes on the following:

  • Both the U.S. citizen and the K-1 visa applicant must have been legally free to marry at the time the petition was filed and must have remained so thereafter. The marriage must be legally possible according to laws of the U.S. state in which the marriage will take place. [source]
    • Include any Divorce/Annulments/Death Certificates from any previous marriages.
    • If the fiance(e) is underage, have a notarized letter of consent provided by the legal guardians; check with your local state laws to see if there are any official forms, and with the beneficiary's country to see if there are any restrictions or requirements that must be met.
  • Have met in person within the last 2 years from filing your K1 petition (sending it to USCIS); You'll need evidence such as
    • Passport Stamps
    • Boarding passes
    • Photos of you together in various locations/landmarks
    • Photos of you meeting her family or vice versa
    • Receipts
    • Conversation logs
    • Phone logs

She is Syrian.

Can someone please help me find the official Louisiana State laws for marriage? I keep googling Louisiana marriage laws and i get websites that are not official some of which say 17 is the legal age, others say parents MUST APPEAR to give consent? is a contest form not enough?

  • Both parents to sign consent forms. Both parents must bring their driver's license.
  • If one parent has full custody, that parent must come in to sign consent forms with his/her driver's license and custody papers showing full custody. Joint custody requires both parent's consent.
