Hi All,

My mother was approved for green card, she is traveling to US in about a week, my understanding that she can file for my bother as soon as she get to US. we can use passport stamp to show as permanent residence, and all we have to send is :

  • I-130 form
  • Birth certificate for both (mother and brother)
  • Green card copy or copy for the I-551
  • $420 ( can i send the check on my name?)

my question is my brother just turned 18 a few weeks ago, and wanted to know if if will have enough time from now to October 2017 to get a visa, i know that he can age in process.

Please share your experiences.

Hi, F2A category is about 2 years so your brother should receive the visa before turning 21. You guys just have to make sure that you don't get any RFE's by double and triple checking everything and when the NVC process comes, pay the fees and send the docs right away.

Yes, your mother can and should petition for your brother upon entering the US. The copy of the passport with the visa and stamp is proof of LPR status, do not wait for the GC in the mail to file the petition.

You don't need mom's birth cert, only your brothers. It's only a regular photocopy by the way, make sure it's legible. You also need a translation for the birth cert and it has to be certified by the translator as accurate and complete.

Also, if mom's name is different than on your brother's birth cert, she needs to include proof of name change and translation if the doc isn't in english, i.e. marriage cert.

The check can be written by anyone, just make sure it's correct amount, it's signed and dated, and that you have the funds in the account.
