Why is the law not changed to issue divorce papers when a spouse dies?

I was thinking about this and it seems clear to me that when a spouse dies, the law should use the death certificate to issue a divorce certificate based on DEATH of one of the spouses. Is it not cruel to keep asking for a death certificate to prove one can re-marry? It keeps reminding the surviving spouse that your spouse is dead. And keeps reminding the new spouse-to be (fiancee) that you are about to marry a 'used' spouse who would still be married if the previous spouse did not die.

Why not a certificate of widow/widowership, rather than a divorce certificate?

06/01/2009- Received Biometrics Letter

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

If a widow/widower is about to remarry, I'd hope that he or she had taken sufficient pause to make sure the grief associated with the memory of the deceased had subsided to the point that mention of someone's name not cause too much emotional pain.

As for the fiancé(e) being reminded that he or she is about to marry a 'used' individual, anyone that has been in a prior relationship is hardly used. And if a fiancé is inclined to think this way, perhaps the union is not recommended ;) BTW, ...what difference does death of a spouse versus the end of a relationship make? One individual, invariably, is not necessarily keen on the relationship ending, and there can very often be disappointment and heartbreak.
