Hi. I have been trying to contact my local us embassy but just get a recorded message.

Could anyone answer this question, please.

I overstayed the VWP for mainland US 2 years ago ( not long enough to get a ban) so can never use it again.

However I would like to take a short vacation in Guam, and see it has a different VWP. Am I eligible for this VWP ? There is some mention of the 217(a) INA ( I can't seem to find out what this is).

I don't want to waste my money on a flight etc only to find I can't enter, and I don't want to incur a ban.

Thanks in advance for any info upon this situation.

Interesting question, but I think the answer is no you are not eligible under the Guam-CNMI VWP, however you could try for a tourist visa.

To be admissible under the Guam-CNMI VWP, prior to embarking on a carrier for travel to Guam or the CNMI, each nonimmigrant alien must:

  • Have not previously violated the terms of any prior admissions. Prior admissions include those under the Guam-CNMI Visa Waiver Program, the prior Guam Visa Waiver Program, the Visa Waiver Program as described in section 217(a) of the INA and admissions pursuant to any immigrant or nonimmigrant visa;

I thought that might be so.

So any idea what this 217(a) is?
