Hi ,

Will f2a retrogress further? The last sentence in the June bulletin is freaking me out. How can there be an increase in demand by applicants with very early priority dates even now? Are they referring to 2011 PDs? Does this mean the cut off date will retrogress again before October ? :(

WORLDWIDE F2A:
The cut-off date for the Family F2A category was advanced at a very rapid pace during fiscal year 2013 in an effort to generate demand to use all numbers available under the annual limit. Those movements have resulted in a dramatic increase in the level of applicant demand being received during the past seven months. This has required the retrogression of the Family F2A cut-off date for June in an effort to hold number use within the annual numerical limit. Further retrogression cannot be ruled out should demand by applicants with very early priority dates continue to increase.

Visa retrogression is a long and painful wait but it happens. My siblings and I experienced it in fiscal year 2011. We're under Philippines F2B preference category which has one of the longest line and longest wait for priority dates to move. Our total waiting time before we had our visas was almost 12 years. Again, almost 12 years of waiting. We have to stay unmarried until we're already in the states and got our green cards, or else forfeit our preference immigrant status.

When we got our notice from the NVC in late 2010 to start applying for visa processing, it was also the start of the retrogression so it took us over 3 years before we received our appointment letter for interview early this year. Not to mention the extra 2-months I endured waiting for my sputum culture results at St. Luke's Clinic and another month for my rescheduled interview.

After my interview, when the very nice lady at the releasing section told me that my visa got approved, I said thank you very much and went to the lady's room. I was so happy, I almost cried. My siblings and I waited for many years, got in line, did everything the legal way and it paid off. Finally, we will be reunited with our parents for good in the U.S. :)

An executive order might, for example, remove the dependents of green card holders from the official caps, which could increase worker green card numbers to nearly 300,000. Yet another proposal would recycle unused green cards from previous years, which could add 200,000 more green cards to the total number allotted annually.

What do you all understand from this

What do you all understand from this

1. Currently the visa totals for each category includes the petitioner and any dependents (which are automatic). So I think what they're proposing here is that only petitioners get visa and no automatic dependents. Therefore, going forward if this is enacted, the dependents will have to be petitioned. I think it's hard to track the automatic dependents so for example, if 200 visas are issues yearly for F2A category and 100 person applies, 50 petitioner could us that 200 if every petitioner has 4 dependents. This would then leave another 50 petitioners with or without automatic dependents. This pretty much is killing the intent for the visas allotment especially in the EB category.

2. I think the unused green card would come from visa allotment to approved beneficiaries who didn't use it or had it revoked.

Just my thoughts though.

  • AILA liaison reportedly asked Mr. Oppenheim of DOS the potential impact of such reform on immigration visa cut-off dates and his answer was that it would accelerate cut-offs but cut-offs would still exist in the family-based peference immigrant visa categories, while such fix would result in all of EB visa categories immediately becoming current and continuously remaining current for the foreseeable future. But within a year of two, filing and approval of new petitions could require cut-off dates for some preferences for some countries. Interesting.................................................''

I guess if the immigration reforms accelerates cut-offs for family-based preference categories we can still celebrate

But my question is specifically when will the reform be effected
