Apply for tourist visa while I-130 pending, beneficiary in India (split topic)

Hi,

We filed our CR-1 in May01,2013 and our case was transferred to NSC on Dec 4, 2013.We have not heard back anything and as my wife is still in INDIA , we are thinking should we apply for her Visitor visa.Our lawyer has discouraged us to do this , but we feel we should try.

Any suggestions and specially if someone tried this from INDIA ? have heard Indian consulates are not too helpful in this matter.

You can try, but (i) from India, and (ii) with a pending I-130, expect slim chance of an approval.

you can apply, its pretty easy actually (the application process is easy not the approval/getting visa)

we applied for hubby's B1/B2 prior to getting married so I don't have any experience of applying once the i130 is pending but I can tell you what we did

Since we live in Bangalore we had to travel to Chennai for the visa interview. I was told to get the first interview spot available on the 1st Tuesday of the month (someone said they have more approvals that day/time). We drove down the weekend before (spent some time in Pondy and Chennai) then Tues morn I dropped him off at the consulate and within 2 hours he had approval for B1/B2. Honestly it was that easy, they didn't ask for any papers or financial proof, just asked why he wanted to go and he said to visit his cousin and see NYC, Cleveland and Philly they had no problem approving him.

now i would think that they will probably NOT approve a B1/B2 for you since she is pending i130 but honestly if you have the money and the time, it doesn't hurt to try at least once just knowing if she is denied the money is lost and you still have to wait.
