I-824 for K-3 visa

Hello everyone and happy new year. Please help me on this issue:

My I-129 and I-130 are approved. My lawyer sent me a copy of the apporoval along with I-824 this file is confusing me.

The file is for someone who:

None of what is stated on that file applies to my case do i still have to send I-824 and $200 to NVC?

here is what confuses me the most: on that file it says that I should us it "to request the USCIS to send my approved visa to the NVC" But my wife didn't go to the interview yet so she doesn't have a visa yet. Any help?

I called the NVC the said that they recieved my I-129 and they have not recieved my I-130 does that mean they will not send me a case number and will not send the file to the consulate unless they recieve my I-130?

I am confused please help

The NVC will send your approved I-129f petition to the consulate within a week or so.

The USCIS will not send your approved I-130 petition to the NVC unless you instruct them to do so using the I-824. Rather, the USCIS will hold on to the I-130 in anticipation that your wife will obtain a K3 visa and apply for adjustment of status after entering the USA. The USCIS will need the I-130 for the adjustment, so there's no sense sending it off elsewhere if adjustment is what your wife is going to do.

If your wife does not intend to adjust status, but rather intends to apply for an immigrant visa, then you should send the I-824 to set that process in motion.

Why are you not asking these questions of your attorney?

Thank you Yodrak for you help. I have a lawyer but he doesn't have any idea what k-3 visa means. He is doing it for the first time he is the one who send me I-824 for fill out so he is the one who is causing all this mess.

So on the original application we stated that my wife will persue an interview at the consulate abraod we gave them the name of the city where the consulate is. We are not making any changement to the original case so do you think I still have to send I-824 or I don't need to?

The question you refer to in the I-130 petition does not have the significance that you think it does, not anymore anyway.

I told you what you need to do depending on whether your wife wants to apply for an immigrant visa or wants to apply for adjustment of status after coming to the USA as a K3. You have not mentioned which would be her preference.

Thank you Yodrak. My wife will apply for K-3 visa and adjust her status once she arrive here in the US. That's what is being noted on the original application. For my lawyer I don't know what to say i don't wana offend him but I am a hotel employee under a Union contract so he is a Union lawyer who does everything. He is there for case . Immigration, work incidents, divorce... ect . That's what you get when you get a free service from a Union lawyer.

Anyway you are right I just called the USCIS and they told me that i don't need I-824 unless I need to adjust somthg from the original application. They already sent my application to the consulate abroad. So i am all set. Thank you all for yoyr support. This website was very helpful to me.

God bless all the members and the one who came up with the idea of making this site.

I am surprised your lawyer couldn't even be bothered to research the visa stuff online. It would only take about 30 min or so of his time to learn the basic differences.

I am in the same boat as the original poster and have chosen to not proceed with the I-130 and instead just wait for the K-3 visa which is in the very last stages.
