Quick question as for I-134 support documents, my fiance is retired from US air force and he get's payment from the Government, in particular the Social Security and the VA. So he can provide the letters from them that state he gets payment, is it sufficient? (he does not recieve pay-stubs no w-2s etc.)

Plus he is not a tax payer, he makes way more above the poverty guidelines.

Comments from people who know the exact answer are welcomed, thanks in advance!

He must get some kind of payment summary.

Plus he is not a tax payer,

Ask Al Capone how well that worked out for him!!

he makes way more above the poverty guidelines.

Good, he needs documentation to prove that.

Comments from people who know the exact answer are welcomed, thanks in advance!

He still will have to file income tax returns, even if he owes no taxes. If he hasn't been doing this....he needs to talk to the IRS quicklly.

Yes he is fine. He can also attach copies of recent bank statements showing direct deposits.

He IS a taxpayer and he has an annual tax return, include a copy of the most recent one, or a tax transcript from the IRS

The consulate suggests docuemtns which CAN be used to support his income. When they give you allist of 4 things, it is best to provide SIX things, not one.

Kiev generally requires the most recent tax return. He has one. Make a copy of it. In addition to the letters I would add whetever evidence of payment he receives (he does receive this) It may not be a w-2 and it may not be a check stub, but he does receive something...everyone does. If he gets direct deposit (he does) then you can simply attach 3-4 months recent bank statements. He receives income documents that have are filed with his tax return.

If he has not filed tax returns, then he needs to. NOW. You will be required to present tax returns at every phase of the process...visa, green card, removal of conditions and citizenship. LPR's and citizens are required to file a tax return every year even if they have -0- income!

In our case I provided an employer letter, tax return, bank letter, bank statements (3 months) and recent check stubs (2 months). All should be as recent as possible before the interview

Try to think of ways to give them MORE than what they ask for. Someone who does not know you makes a decision about you based on what you give them. Give them plenty.

OK, many people do not have taxes withheld (deducted from income) His situation is normal for his income.

I think it is best to provide as much as you can. He can go to the interview but they are not going to ask him any questions and they are especially not going to ask questions about taxes. The interview will last 30 seconds to 2 minutes, not more. There will be few, if any questions. They will be asked to YOU, not him. If he tries to answer they will tell him to sit down and be quiet. It is YOUR interview. He can hold your hand.

When you arrive you will turn over all the documents and they will be reviewed by an officer, in the back room somewhere while you sit in the waiting room.. The decision about income is made before the interview. If they are not satisfied with what you give them, they will give you a 221g notice, withhold the visa and tell you to bring back the needed documents at another time. They don;t have a meeting about it and they do not accept explanations at that time.

This is why you want to give them MORE than they ask for so there are NO questions. Our "interview" (I was there)_was "no questions asked" We were called to the window, Alla was told her visa was approved and they gave back her original documents and photos. That's IT.

Kiev is easy to deal with but they DO require all the documents and support evidence. Give them that and you will be approved easily, leave and go celebrate

с Новым годом

P.S. for people who will someday discuss taxes and who should file and who does not file tax returns. As I was saying NOT ALL IN THE US FILE TAX RETURNS, there are categories who do not do that, especially if they are Army retired.

Here is the info from IRS:

Military and Government Disability Pensions

Certain military and government disability pensions are not taxable.

Service-connected disability. You may be able to exclude from income amounts you receive as a pension, annuity, or similar allowance for personal injury or sickness resulting from active service in one of the following government services.
  • The armed forces of any country.

  • The National Oceanic and Atmospheric Administration.

  • The Public Health Service.

  • The Foreign Service.

Conditions for exclusion. Do not include the disability payments in your income if any of the following conditions apply.

  1. You were entitled to receive a disability payment before September 25, 1975.

  2. You were a member of a listed government service or its reserve component, or were under a binding written commitment to become a member, on September 24, 1975.

  3. You receive the disability payments for a combat-related injury. This is a personal injury or sickness that:

    1. Results directly from armed conflict,

    2. Takes place while you are engaged in extra-hazardous service,

    3. Takes place under conditions simulating war, including training exercises such as maneuvers, or

    4. Is caused by an instrumentality of war.

More info as who should file for tax returs and who does not file is here: http://www.irs.gov/publications/p525/ar02.html#en_US_2013_publink1000229314
