Just a bunch of questions related to I130 RFEs, especially as of late with all confusing USCIS messages...

For those that have knowledge or have experienced...

Is there any difference in what they are really asking for if the RFE message on your status says "additional evidence" versus "initial evidence"? Anyone with experience want to share what they were asked for and what their status said?

Also has anyone gotten I130 approval based simply on marriage certificate, no supporting evidence such as photos, financials, emails/phones etc...bare minimal marriage cert only...

08/15/2007 Filed AOS based on approved I140, EB3 category (Employment Based). Received RFE and responded....Pending since then.
I-130 Timeline:
07/03/13 - I-130 packet sent
07/05/13 - I-130 packet delivered
07/10/13 - NOA 1 with PD 07/05/13
Last touched 07/10/13
12/9/13 - Case update to "transferred to another office for processing" and received text and email alert.
12/10/13 - Case update "transferred to local USCIS office for processing"
12/12/13- Case update "transferred and being processed at a USCIS office"
12/14/13 - Received 2 hard copies stating transferred to California Service Center, left Priority Date blank
2/5/2014- Email/Txt I130 approved and notice mailed.
2/10/2014-Hard Copy NOA2. Approval

2/21/2014-Letter sent to request conversion for old I485 from employment to marriage with copy of I485 receipt and I130 approval
03/19/2014 - Service request to check on conversion request status.
04/04/2014 - Service request status through mail stating request received for conversion and file being prepared for transfer to local office.
04/08/2014 - I485 updated to "transferred to local office"
04/12/2014 - Received transfer notice in mail stating file transferred from Nebraska to NBC Lee Summit, Montana (so disappointed as I thought it was at local office now).
04/14/2014- emailed Nebraska and scopscata to see what's going on with file due to conflicting info I've gotten and NBC doesn't even show processing I485.
04/14/2014- Got response from scopscata saying will look into email, forward to resolution team.
04/14/2014- I485 updated to "485 was transferred and is now being processed at USCIS office"
04/25/2014- Text message and case update online "testing and interview" stage.
05/06/2014- Text message and case update online with interview date of June 11, 2014.
06/05/2014-Notice sent by NYC acting district director/office that interview date is Aug 21, 2014.....??????????? No change online
06/11/2014 - Interview for AOS. I130 was already attached. Approved and got passport stamped. YAY. Thank God.
06/19/2014 - Case updated online with text and email saying new card mailed.....

06/21/2014-Condtional GC received along with welcome letter.

Yes many have. I know of a few but unfortunately they also got denied at embassy. I know two people who sent in nothing but the certificate one just got reaffirm interview this month. The other has interview next month. So it was a 13 and 15 month delay because they didn't send in evidence.

Then there are some like from the VWP countries who did just the marriage certificate and were fine, It really is one based on the adjudicator and if they request more evidence. If you search through Visajourney you will see many couplkes say all we sent was our marriage certificate. Look at the country they are interviewing at.

Initial evidence is the required documents and the evidence you want to support the bonafide relationship.

Additional evidence is when the adjudicator may need more. Maybe it wasn't clear of the relationship. Like I said its all based on that adjudicator.

I only sent my marriage certificate and my wife's birth certificate and we were approved, but then again every case is different so it's better to be safe.

Even if your country requires the bare minimum, it's still a good idea to front-load so as to not leave any doubt, in my opinion.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

I only sent my marriage certificate and my wife's birth certificate and we were approved, but then again every case is different so it's better to be safe.

Nop recommended for anyone coming from your country at all. You got lucky and you got a lazt adjudicator.

Its not every case its every adjudicator is different. This is why you see on VJ the word "Front-load" your evidence. Because many of us at high fraud embassies never get to show evidence at interview. Out love ones coming loaded down with pics and emails and all the tonage because many are lead to believe they will get the opportunity to show evidence at interview and many times that isn't the case.

At best you have 15 to 20 minutes with a CO. How in the world will they read all your emails and IM's and chats and see pics? So we front load so one USCIS approves it and this is in the hands of the CO weeks before you ever show up. Because truly the decision is made before you come to the interview so why not send your best evidence to show the bonafide of the relationship.

I followed visajourney and added pictures showing us in each others country and with family members. I still got a RFE for additional evidence but it said the letter would say but no letter to date. Confusing....

I-130 Approved : 2014-01-13

NVC:

NVC Received : 2014-02-21

Received DS-261 / AOS Bill : 2014-03-10

Pay AOS Bill : 2014-03-10

Submit DS-261 : 2014-03-10

DS-261 form reject- under review: NVC keeps saying the form is incorrect. They made an error for two months re this form.

Checklist 1 AOS : They wanted 2013 even though we filed before the end of tax season

No telling until you get letter. No need to second guess. It could have been an unsigned form a forgotten form or a pic, Birth certificate. Hold on it should be here and all will be unconfused.

Yes I did, I send just what the paperwork ask for and noting else. And I got my I-130 approved on 24 Sept 13 without any other document.

Our I130 was also approved and we only sent the marriage certificate with no supporting evidence. Our attorney never requested anything else and if I would have been more informed when I started the process then I would have sent all of the evidence with the I130. My husband's appointment is next month and after reading some of the replies to your post, I'm getting worried; not because he doesn't have the evidence but because he may not have a chance to show it :(

"No my lawyer said just send marriage certificate if they want more they will ask". Okay fine. Well for her thank God she got a lazy adjudicator because she got RFE for more evidence. So for her thats good so hopefully her lawyer is not an idiot and will load it up now.

Some embassies you just can't play with jmark2743 is UK they are a very nice Hospitable embassy and really them and Canada you can go through the whole process and not show anything but a marriage certificate. Hardly the case for the MENA's, Africa, Pakistan, Philippines or India. Not happening.

Thats why at NVC you have a second chance to side-load as we call it and send in what you didn't to USCIS. So there's always ways and yes it does work.
