embassy told to my fiancee congresman that they sent our case to uscis cuz i am married . and this not true. so what should i do?

oh yeah another thing I wanted to add is just before this they called you to renew your medical so somekind of mistake happen.You need to work on it asap

According to our records, Mr. Maklad appeared for his final visa interview on January21, 2013. According to the I-129F petition, the petitioner and beneficiary are fiancés and will marry once the beneficiary is granted his K1 visa. The interviewing officer referred the case to Post's Fraud Prevention Unit (FPU) to determine the beneficiary's marital status.

FPU's investigation determined that the beneficiary had married Marwa Elsayed Elmetwaly Ibrahim on June 30, 2011, with no divorce between them. Thus, his marriage to the petitioner would constitute a second marriage for him, and would be invalid for immigration purposes. As a result, post returned the petition to the National Visa Center to be sent to USCIS where it was initially filed with recommendation to revocation of this petition based on evidence that the beneficiary is already married in Egypt and is not entitled to this immigration benefit

i want to inform the embassy that i never got married before and i can prove it easily because all of this information not true and i can send to embassy any required papers they will ask for it to prove it and i can send them too

Family Registration Copy القيد العائلى
2- Extract of an Individual Registration القيد الفردى and notarize them from Ministry of Foreign Affairs to prove that i am not married and never got married before

Have your fiancee email the embassy and tell them that you can provide those two documents (name them in the email) to prove that you are not married and that there was a mistake in their investigation. Translate both documents and send both the Arabic and English versions to the embassy. Make sure to include a letter explaining the situation and your case number!

Have your fiance call the Department of State and find out if the paperwork has left the embassy yet. If it has left the embassy, then the embassy may not be willing to look at the paperwork again.

Keep her Congressman involved and inform him of everything that is going on.

The USCitizen Petitioner should be further communicating with the Congressman about the error at the FPU .

Since the FPU got it wrong, it's possible for an ILS human with the Congressman's office to communicate further with the FPU (not you, not the USCitizen Petitioner, only the ILS human) and bring this matter to the FPU's attention once again.

It's on yer USCitizen Petitioner to write the request for the ILS human, so if I was in your exact shoes, I'd be practicing with her for writing the request for the ILS human, at this moment, then sending it off soonish.

You'll have some problem with time and timing because of the Christmas holiday, to get any action or subsequent response, but

you have one inroad on this. One. If the ILS Human not get engaged quickly and the request to FPU not get in quickly, that casefile is going to get returned to USCIS. Once it's left the IV Unit, there's no telling what will happen - a review at USCIS could occur, or USCIS would let the petition expire, or something else.

I agree with the advice given here.

1. Email embassy section chief of mistake made.

2. Get the notarized proof that you are not married from the proper department.

3. Keep the congressman involved at all times.

Once the petition has been returned to USCIS it will be almost impossible to correct the mistake because it is out of the CO's hands.

You would then have to start over and submit proof because you will face the same issue.

Time is of extreme importance to get in contact with them.
Have your congressman also immediately email and insist they correct the mistake and send proof.
Make sure the congressman understands that time is of the essence, some do not know that K1's will not get reviews.

Let us know what happens.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

but it's imperative that your USCitizen Petitioner actually engage with the Immigration Liason Staffer (ILS) human at the Congressman's office.

I've written stuff that may be new to you - I ask you forward the link to this post to your USCitizen Petitioner, and have her read what I've written - you are going to miss things with translation and waste time.

Time wasting, even an hour, could kill all given the holiday schedule.
