Oh my God! Cr1 Case Got Reaffirmed yestesterday

First of all Thanks to God. to listen my Prayers.

And Thanks to Vj friends who all advised how to over come the denial of Cr1 visa..Our CR1 visa petition Got Reaffirmed yesterday .

Now how long it will take the case to come to Delhi Embassy and to get date of another interview? will it be beneficial if my husband attends the second interview with me?.Its More then three years of our marriage but still fighting to get the visa to join my husband..

From reaffirm to getting a interview varies. I know 4 people (3 Nigeria, 1 Pakistan) all reaffirmed august and september. 2 got interviews this month, 1 next month one for Pakistan still waiting. So it depends.

I would say hopefully India maybe 2 to 3 month wait. Just hang on. Almosy there. Congratulations.

why was the visa denied at the first interview (if you don't mind)?

Visa was denied under act 212A5A 9FAM40.1 for not Bonafide relationship and sent back to Nvc

and when we got NOIR with all consulate objections on 17th October and submitted the documents on 14 November to USCIS and case got reaffirmed on 17th December

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I am sorry this might sound like a stupid question. But how was your visa reaffrimed....what does this mean? My fiance was recently denied his k-1 visa. The CO said she was not convinced of our relationship. How did you over come the denial? Somebody told me that once I hear from uscis that I need to submit documents but I am still confused by this whole process. Did you hire a lawyer?

You are a K1 they are a spousal CR1/IR1. No their Visa was not affirmed because they never got one the petition was reaffirmed, meaning CO denied it sighting that they will send back to USCIS so they will deny or revoke.

USCIS requested evidence to backup the denial points the CO states in their claim. They send back to USCIS they review and they were reaffirm meaning they are now sent right back to embassy for 2nd interview where the majority of time they will be approved.

Since you are a K1 coming out of California Service Center your petition will expire before you would be able to do anything. Rarely if ever K1's get reaffirmed because they expire. Most couples just go ahead and get married during this long wait because you are waiting really for nothing. Or they refile. The choice is yours.

You are a K1 they are a spousal CR1/IR1. No their Visa was not affirmed because they never got one the petition was reaffirmed, meaning CO denied it sighting that they will send back to USCIS so they will deny or revoke.

Hi first of all congrats on reaffirmation, our case is also reaffirmed and i am from Pakistan and our case was sent back by uscis in aug 2013 since then i am waiting for interview but i hope and pray that you just have to wait may be 3-4 months. All the best and wish you that your love one join you soon . In feb 2014 it will be 3 years of our marriage and still waiting to get my visa one day and i will join my husband.

Hello. First of all, congratulations on getting your case reafirmed and let's hope they don't ask too many questions. I used to be in the same situation after my husband's visa was denied for the same reason. Our case was reaffirmed and sent back to the embassy. I made an appointment for my husband's interview on ustraveldocs and the consular didn't asked him questions. Just one question about our newborn. Well, everything went good but we got AP for background check. We are still waiting but we are not giving up. Edited by Winky
