Having a child during IR1-CR1 process

Hey everyone - just curious, what would you need to do in the event that my wife and I have a child while our case is pending. Would having a child complicate the process?

If the USC meets the residency requirements, the child can obtain a USC passport, the CRBA must be filed.

The household income requirement would also increase by 1

If the USC parent does not meet the residency requirements for CRBA, a separate i130 must be filed for the child.

Hi!

Actually I know of two friends who had children during the process or their spouse was pregnant during the process - for each of them it sped up the process - especially since one of them sent in sonogram photos with their i 130 petition and the other send photos in of the baby when they got asked for more evidence.

In each of these cases it was the wife - a US Citizen who was pregnant!

Pregnancy does not speed up the case.

Look on this forum for the numerous time that expedites requests based on pregnancies have been denied.

If you have lived in the US for 5 years, then your child will be a US citizen based on the fact that you are a US citizen.

If the child is born in Vietnam and you meet the 5 years residency requirement, then file the Consular Report of Birth Abroad (CRBA) at the Consulate in Saigon. Get a US passport for your child.

If the child is born in Vietnam and you do not meet the 5 years residency requirement, then you must file an I-130 for your child. Request an expedite based on the petition for mom.
