My husband filed my I130 (for CR1) thinking that one application includes me and the kids (both with some degree of special needs). I finally got my case approved only to find out that the petition only applies to me. I was told by a visa assistance center here in the Phils that I would have to leave them behind while I petition them myself in the US. I have no one with whom I can leave my kids behind for such a long time, is there anything I can do? Please please help me.

Are the kids also your husband's biological children? Or are they his step-kids?

If stepkids and you married before their 18th birthdays, your husband can file i130 for them. They will be CR2.

In the meantime, you can delay your case for up to a year in the NVC stage while you're waiting for your kids' i130 approvals.

Thank you so much Apple21!!! They're both my kids- my husband's stepsons. The eldest was 18 when we got married so that means he can't be CR2 :-( My second son is 15 yrs. so that means he can be filed for CR2. I guess we really would be separated - that would break our hearts, I don't even know If I can actually leave them behind. What happens to my eldest then?

Your eldest does not qualify for CR2. You will have to file for him yourself. He will be under the F2A category (unmarried child of LPR). Waiting time could be more or less a year depending on the movement of the visa bulletin.

What you can do is Hubby files the Cr2 for the younger child You come to the US, File the petition for the other son , Get a returning resident paper ( lets you be out of the US for over a year ) and return home to wait for the petitions to get approved. You could file for both children actually .

This will not be over quickly. You will not enjoy this.

If they're special needs, is there any way they could get an expedite on humanitarian grounds? Just wondering.

Just have husband file now for your son's you can wait at NVC for them and request USCIS expedite your son's pettions to get caught up with you. Hopefully you can be approved under 30 days. So file ASAP.

Thank you all for your response and input!!! My husband and I are contemplating on getting an immigration lawyer who holds office both here and in New York whom we have looked up and seem to have a very good track record. We are absolutely heartbroken over the news and are hoping and praying that our eldest son (very mild mannered and caring - he can really crush a proud person's heart) would never have to undergo such trauma of long separation.

If the older one was already 18 your husband can NOT file for him. You have to and as an LPR there is a wait for a visa number Were you in an area affect by the storm ? Could you get one of the expedites based on that ?

This will not be over quickly. You will not enjoy this.
