Who gets a conditional green card?

Hi,

I have tried to find a clear answer to this but I could never get a clear answer till date.

So I understand that if you get a marriage based green card, and you have not been married for 2 years when the green card is issued, you are given a conditional green card.

Is this valid for everyone? My question is around the fact that I am applying for AOS currently. I am married to a Permanent Resident. We got married in January 2012 and right now, we are nearing end of August 2013. Now, if my green card is approved soon (hopefully), will I get a conditional green card? If yes, then as per the rule, I will have to file I751 in October 2013 (90 days before 2 years anniversary)? Is that correct??

Hi there -- from what I understand, as this is the juncture we are at too, the "2-year anniversary" means the 2-year anniversary of the issuance of your temporary green card, not the 2-year anniversary of your marriage, so the time to file for lifting of conditions would be 90 days before the expiration of your green card. - Best wishes

yes, but if you recieve your first card less than 2 years from your wedding it will be temporary...if you recieve it later than 2 years from your wedding it will be permanent.... So only if you recieved your GC after January 2014 it would be permanent... In your case you'll most likely get it before that so it will only be valid for 2 years and then you are gonna have to apply for a new one 90 days before this one expires...

Hi Ramu2012,

Please note that if you are approaching the 2-year anniversary and your resident card has not been yet approved/issued, you may just get the Permanent Resident Card. I believe they have a time frame, I am not sure exactly, but you're very close to your 2-year mark. I'm researching this time limit.

Best of Luck.

Kel

LPRs can file AOS ? Really? OK !

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Hi Darnell,

Sure...

http://www.uscis.gov/portal/site/uscis/menuitem.eb1d4c2a3e5b9ac89243c6a7543f6d1a/?vgnextoid=be1ea6c515083210VgnVCM100000082ca60aRCRD&vgnextchannel=be1ea6c515083210VgnVCM100000082ca60aRCRD

Sounds like Ramu2012 is under the F2A category, which is now current, hence able to submit the I-485 to adjust status.

Thanks,

Kel
