Hello,

I'm filing the I864 form out for my mother (only joint sponsor) and need some help.

On part 5 (household size)

The sponsor is my mother, her dependants are my two brothers, my husband (the immigrant) and myself.

However, the form won't let me check the "yourself" box for my mother, nor does it seem to have an option for myself.

I'm guessing we only count "4" as I am neither a dependant nor is she sponsoring me, so I'm not included? Or am I?

ALSO,

As far as tax returns are concerned, my grandmother files everything for myself and my mother.

The tax returns she has are filed by her tax guy electronially and he sends her personal PDF's.

The instructions state:

You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years.

"From your own records" I'm not sure if they mean a physical piece of paper that the ACTUAL guy gave to us, or can she simply print the PDF returns??? Since technically those are the same thing?

For this form, dependents are defined as people claimed in the tax return. Since you are married, an adult, likely supporting yourself in some way, and not a full time student--I don't think you qualify to be claimed by your mother on her 2012 tax return. So no, you are not counted on Mom's I-864.

If the tax guy gives you a PDF of the tax return and it has pages entitled

Form 1040 (or 1040A or 1040EZ)

Schedule A, B, D, etc

Then that is what you photocopy. But with it you must send the form W2 or form 1099 that comes from an employer each year telling the wages earned. It adds some proof that that PDF photocopy shows real wages and you didn't just make up a fake tax return online

OR

Order free tax return transcripts from the IRS. I've ordered a bunch of times and they have always arrived within a week. Various ways to order.

The second page gives fax numbers where you can fax it in rather than mail if she has a fax machine. It is separated by state where living.

3) Automated request by phone 1-800-908-9946.

The tax transcript is a stand alone abbreviated version of the tax return. It needs nothing else with it like w2s because it comes from the IRS.

Is your mother married? If so, then she needs to also count her spouse in Part 5, question 3.

It's Mom and two boys on her tax return. No husband.

Catie lives in the UK with her husband.

Her sister lives with Grandma and is on Grandma's tax return as a dependent.

Not sure why it didn't post my reply from earlier...

I took a look at the PDF's... it has the 1040, income tax return, W2 and 1099...

She is self employed, so she wouldn't be getting any W2's or 1099's from her employer.

The first page of the pdf also has our tax accountant's name, address and phone number.

Mine is the same.

I ordered the transcripts in case you said this wasn't acceptable, yesterday.
