Here is the situation:

I am the petitioner, USC.

Wife is the beneficiary, is in India.

I got the AOS fee paid online and the printed out the AOS receipt cover page with bar code.

AOS packet is almost ready except my 2012 tax return transcript.

I sent my 2012 federal tax return (filed jointly) with W7 (ITIN#) for my wife to Austin Texas on April 14th 2013.

After getting RFE from IRS about sending original birth certificate and driving license, IRS approved and assigned an ITIN # to her (got the ITIN# letter this Monday).

Now I am waiting for the 2012 federal tax return transcripts available on IRS website and checking everyday their website and every time it says the 2012 transcript does not exists

Question:

How long it takes for IRS to put my 2012 transcript into the system?

Should I wait for the transcript or send the AOS with 2012 tax return paper with supporting documents?

Is it worth waiting for the 2012 transcript?

If you have photocopies of your 2012 tax return, along with supporting forms then it is better to send those in, rather than wait for 2012 transcripts.

I do not have the photocopies of the 2012 tax returns I sent but have the copies generated out of turbo tax (not signed). Will that be ok? or NVC will look for the exact copies I sent to IRS?

I would sign those copies, and send to NVC, along with the supporting documentation.

The copies generated by Turbo tax are copies of what you filed, are they not ? What else would you have filed ? If they are the same then those copies are fine, just sign them. But don't forget that now you must include W-2"s, etc.

Yes, they are copies what filed. I will sign and send the supporting documents with it (W2..etc)

But we both have to sign? My wife is in India

When I filed in last April, what I did is, I sent the page where joint file signature required to India and my wife signed it and sent it back to me.

I wouldn't wait for the tax return transcript to be available. That could take a while. I was in the same situation as you. When I was ready to sent my AOS packet, I didn't have my 2012 tax return transcript (and still don't!). In my AOS packet, I sent in a copy of the tax return I filed. I did not send them the W7 ITIN page, but I sent the rest (1040, W2, 1099s, etc) along with 2011 and 2010 tax return transcripts which I ordered earlier. I finally got my wife's ITIN letter last week. Those morons lost the certified passport copy I sent to them, so they had to look in their office to find it which has slowed my return process :( Don't know when the transcript will be available. If it's not available by interview time, I will take the copy of the tax return.


I forgot to make a copy of the signed return, so I just printed out the filled out forms and my wife and I signed them again. I did my best to guess the date I put on the tax return that was sent to the IRS. BE SURE TO SIGN your tax return though before sending it as part of the AOS packet. Otherwise, you will get a checklist.


I sent the signature page to my wife in Canada. She signed it and sent it back to me. I signed it and rescanned it. Only thing is that Montreal has Electronic processing so I only had to send a scanned copy of the return. I assume you have to send the paper document since India doesn't have electronic processing?


I personally didn't have any issues at NVC, no checklists or anything.
