Second pair of eyes for i130 checklist

Hi guys,

This is the checklist we are using for our IR1 fiiing (standalone i130 DCF)

Could you guys advise if this list is sufficient ?

i) Three years of tax returns filed as married filing jointly in the US

ii) Three leases spanning three years in various US states

iii) Bank statements from two different banks (10 each)

iv) Credit card statements from two different banks (10 each)

v) Copies of drivers licenses from two states in the US

vi) Copies of Insurance Explanation of Benefits (EOBs) (2 copies)

viii) Marriage Certificate copy

viii) Copies of Auto Titles for jointly owned cards (3 Total)

viiii) Copies of ongoing cellphone conversations (calls and text messages)

Is this enough ?

Should we include wedding pictures or the invite ?

Please advise

Your list of evidence indicates that you've been in the US for a while. Are you sure you're eligible for DCF?

To answer your question, that's way more evidence than I'm submitting, but I'm filing with a very trusting consulate (Frankfurt).

DCF Frankfurt

2013-08-01 Married

2013-08-02 I-130 package sent

2013-08-05 I-130 package arrived (according to tracking)

2013-08-06 Fee charged to credit card

2013-08-09 Received NOA1 in the mail

2013-10-19 Received NOA2 in the mail, from Athens?!?! "Your petition...has been forwarded to...Frankfurt."

2013-10-24 Requested tax transcripts from IRS (for affidavits of support)

2013-10-26 Received NOA2 from Frankfurt with new case number

2013-10-26 DS-260 completed online

2013-10-28 Request for interview mailed

2013-10-30 DS-260 resubmitted with correction

2013-11-04 DS-260 resubmitted with addition of US permanent address

2013-11-05 Immigrant visa document package (packet 3) mailed

2013-11-15 Letter with interview date received in the mail. Interview date WAY too short notice to get medical done in time

2013-11-18 Emergency trip to Frankfurt to get medical done

2013-11-19 Walk-in medical in Frankfurt (limited walk-in hours, so couldn't do day before interview)

2013-11-19 Finally get email response from consulate saying it's OK to get the medical done after the interview (too late)

2013-11-21 Interview in Frankfurt

2013-11-26 Visa received. Woohoo!

2013-12-24 POE Seattle - they were confused by lack of paper DS-230

2014-02-08 Green card arrived in the mail

2014 Social security card never arrived - got one at local SS office

Hi,

Thank you for your advice.

My consulate is Mumbai so you never know.

I lived in the US for 10 continuous years, I briefly had a 10 year green card based on my 4 year marriage with my spouse, ran into some problems with my wife and submitted a i-407 (abandonment of card)

Long story short, we've reconciled and now I want to go back.

DCF is the only way.

We are still married, intend to file taxes in 2014 together, talk everyday and have proof of an ongoing relationship

Hi,

To file DCF in India, you have to have been a resident in India for atleast 180 days - for this you would need proof of employment/house lease/utility bills in India in your name.

You would also need photos.

Also, you have to file in person in Delhi.

Filed for DCF for my husband in New Delhi, India

Timeline:

29-06-2012 - Got Married in Bangalore, India

04-04-2013 - Filed the I-130 in person in New Delhi

No NOA1, NOA2, Packet3, Packet4

26-04-2012 - Interview Letter sent out

09-05-2012 - Interview letter received

24-05-2012 - Interview Date

Interview Result - Approved

Filing to interview date = 50 days!

Timeline

Wife is in the US (because she supports my mother-in-law who is terminally ill) and I am in India.

We went to the Delhi embassy and were told to file at the lockbox only.

They do not do DCF at Delhi

We do not have a co-sponsor so my wife has to keep working the entire time.

Hmmm.. Delhi does process DCF - or atleast they did 4 months ago. But maybe that is only for US citizens and not for greencard holders.
