Local Office? Filing from Canada

I am an American living in Canada with my Canadian husband, we filed our I-130 in March and I was wondering, because we are filing from Canada, what local office will it be sent to?

If you didn't list an US address as your permanent address they will process at the NBC office where all I-130's start.

Be sure you start setting up domicile proof. Here's the NVC filers thread read Post #1 and Post #2. Much needed for your next stage.

Thanks so much for this! We have decided to move our family (we have 2 kids) to the US to be closer to my family.

We are using an attorney but I am trying to wrap my head around all of this as well, the more I know the better I will feel. As for the domicile proof that scares me as I have been living in CA for the last 10 yrs as a Perm. Resident...I have virtually no ties to the US at this time. I let my DL, credit cards etc.. go many years ago.

You will need to reestablish those things before the interview. It is one thing that Montreal is quite sticky about. There is a thread in the Canada forum about how the petitioner can prove ties to the USA.

Please travel over to the Canada forum, domicile is a huge issue with Montreal and you may be required to move to the US prior to your spouse before a visa can be issued. There is a sticky there with stories and advice for those going through Montreal.

I'm in the same postion. As soon as possible I would get secured credit card either Visa or Mastercard. I went through Capial One and used my parentss address. It's worked great so far, I use it when I'm in the states or if I buy a family member there a birthday gift etc online.

Helped my credit score to get approved for a mortgage.

Would it make a difference if the US address you use of credit cards and bank accounts is not in the same city as you plan to live?

I would personally fix that. They're going to want consistency.

You used your mother's address in NY as your mailing address for I-130 purposes? Then, your I-130 will be going to the local office with jurisdiction over that address.

Maybe you'll luck out and it won't.

Oh yeah you shouldn't have done that. You would have likely received your NOA2 by the end of the month if you hadn't done that. NY field office is very slow so you'll be a while with that one. However, it's a big pain to change it and they often won't change it to an out of country address.

We used our address in Montreal as our current address on the biographical information for both my husband and I. We used my Mom's address as the address as the perm address in us where we intend to live....so are we still screwed?
