Dear All,

I will be soon sending my AOS package with form I- 130, 1-765, etc. My question is do we get to choose the date for the interview? Me and my spouse have really busy work/school schedules. We both have class and work from M-Th, and Friday is the only day we both can make it. So is there anything I can do to request USCIS to schedule the interview on the day I want?

If the answer is no in the above case, will I be able to select the date if I plan to re-schedule the interview?

You do not get to choose any of the dates. Biometrics, interview or otherwise. You can request a change of date but it could be months before the next date is given and they choose that one too regardless of your schedule.

As you are not on a family based visa your topic has been moved to adjustment of status from work, student, tourist visas.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Hey!

School is getting over in about a week or two (unless you're in med school because you might be then entering into your next Block). If you submit now, you might get the whole AOS process over before Fall. Good luck!

Thanks! We both will be going to school in Fall. If I submit my complete package by the end of this month, based on the research I did so far, I speculate that my interview date will fall in somewhere around late Sept or early November at the earliest, if everything goes right.

Okay, your cal. I don't think it's a big deal to miss one and a half hour (maximum counting waiting in the waiting room) for an AOS interview, but whatever floats your boat, man. We are also in school, and we submitted our AOS at the first week of September, and we got the GC at the end of November. But up to you, really. I kind of feel you're making a way bigger problem about this than it could be. We drove to the office in about half an hour, waited about another 10 minutes, and the interview was good 5-10 minutes and then drove back, again, another half an hour. Summing it all up, it's two lectures being missed, or one lab practical class (if you have that). I think it's quiet do-able, and this should not be from stopping you. If you mailed it in today you might as well have your interview in August, or first week of September, and have your green card by the end of September. No other time is best than now, when summer in and school is out (unless you're taking summer class). But again, can't bare enough to repeat this: at the end of the day, the decision is yours. Good luck!

Trust me dude, we are doing our best to send our package ASAP. I planned to apply for joint bank accounts and all other documents (utilities, internet, insurance etc) where I could possible include my spouse's name and it's taking time to get this all done :(

That is a hole lot of different story. I'm sorry, I was under the impression that the ONLY reason you are not submitting it now is because you're afraid of missing one possible hour of lecture in the fall, if it came that late. If you are not ready that is different. Take your time, prepare everything, and submit whenever you are ready. I just wanted to make sure that one hour of lecture missing is not something that will stop you from submitting your otherwise completely ready AOS package. Sorry for the misunderstanding. No worries, you'll be done in no time. :) Good luck!

You don't absolutely HAVE to have all these joint accounts when you submit for AOS. My husband and I submitted documents for two joint accounts and an affidavit from my mother in law. We wanted to get our application in asap. We are going to bring all the additional proof of marriage ( utilities, internet, home, health, car and life insurance, pictures etc.) to the interview!

04/02/2013 (day 1) - Delivered to USCIS Chicago
04/10/2013 (day 9) - Received USCIS Acceptance Confirmation email. Awaiting official receipt notice (Form I-797) in the mail!
04/15/2013 (day 14) - Received NOA in mail, Biometrics appointment for 5/7/2013.
04/17/2013 (day 16) - Attempted walk in for biometrics = denied

05/07/2013 (day 36) - Biometrics appointment completed in Baltimore, MD

its true you can actually do that but to be honest, i think if you can get hold of it now then u mught as well send it with the aos form. am always scared of getting RFE

No the letter does not need to be notarized. The write should include their full name, date and location of birth, address. They should explain in the letter their relationship to you both, how long they have know you, how long they have known you as a couple, how they have observed you have been in a committed relationship/marriage and that they can certify we are in a bona fide marriage. It doesn't have to be a super formal letter... I think when the letter writer makes it a littler personal it's better.
