Hi all,

Please excuse me if I post this thread on the wrong session of the forum. Just a quick background information. I arrived in the USA with a CR1 visa about a year ago from the UK. My wife is a USC, we have been married for 2 years. Our marriage did not work out, I was subject to emotional and constant verbal abuse.

I moved out of the house about a month ago, she has constantly harassed me after I moved out, coming to my work, track me down to my new address, I called the cops whom came to escort her away. I filed for restraining order prior to her coming to my new address but got denied due to lack of physical abuse evidence.

She has contacted a divorce mediator, appointment has been scheduled expected to take place later this month. We have no property together, no children, though she does have children from previous relationships.

I own a house in the UK, I bought my house before we got marriage, she has mentioned in the past that if we get divorce everything will be shared 50/50. She owned some huge medical bills not covered by insurance even before I arrived in the USA. I remembered one occasion that I have to drove her to the emergency room, we were in the hospital for 3 hours and that bill came up to $6000, she signed the paper work. I was only 2 months in the US at the time and I have no job. She just took up a new job at the time and her medical insurance did not cover that bill.

My question is would my wife demand that I pay half of the medical bills she owned. I know is too early to speculate. But I believe this is the only reason she want divorce mediation. Would I be liable just in case? I would appreciate any advice

In regards to property that you own, it will all depend on how good your lawyer is, but chances are she is entitled to half, legally.

Her creditors may and most likely will come after you for payment of her bills. While she may not force you to pay them, as her husband they may action you for payment. It may ruin your credit for a long time.

some states are different, definitely try to get a consultation with a family law practitioner. If the mediator is state appointed, then you might be okay addressing it in that forum

Just to add, we have no joint account neither in the US or in the UK. The house is mortgaged and I rented it out when I move to the US.

Mark, all the same she can put the house in the mix, because by law you have to report the income from the rental in the UK in your US taxes.

Wow, we filed a joint tax returns earlier this year but that rental was not included as the rent is basically paying the mortage.

It would be very wise of you to amend the return and include the additional income derived from the rent if you are planning to keep your residence in the US. (Consider addressing that with your lawyer asap.)

Will seek external help on how to amend the tax returns, now we are not communicating with each other.

You might want to let sleeping dogs lie regarding your tax returns.
