Hi everyone

I am new to VJ and I want help/ advice from u about my case. We have so many red flags in our case as my husband had applied two times for visitor visa before our marriage and as he was refused in India first time saying that apply from Australia as he was having Australia student visa. I met him in 2007. I was married to someone else and we be ome friends. Second time he applied from Australia and he was refused stating that apply from India as his student visa of Australia was going to expire. After my divorce in 2011 we came closer and we got engaged . Then I applied k1 visa for Him in 2012 which was also a long process due to RFE. He was also denied for visa and CO gave him 221 g for invalid petition. After that we got married in Jan 2013 and now in may 2013 I am pregnant with his baby. Due to three refusals at I am very scared before applying b'coz this time I'm really want to go US ASAP for my baby. Please suggest me how to overcome these refusals.

Hi Preet18,

As an aside, babies of US citizens automatically qualify for US citizenship, regardless of place of birth. So you should look into that, if that is your concern.

Apart from that, what you need to convince USCIS is that the marriage is genuine. Given the history, USCIS will be suspicious that the marriage was purely for the green card.

How long have you been married? How long have you been living with him in India? The longer you've been living with him, the stronger your case is. Gather documentation like lease agreements, utility bills, common bank accounts, common health insurance etc to show that you guys are living together for a while.

A baby definitely helps to strengthen the case btw.

If you haven't been married or living together for too long, I would be patient and wait for a while, gather documentation, and then apply with a stronger case.
