Technically K1 is a non immigrant visa but is processed as an immigrant visa.

Hi, thanks for the reply. I can't see where it asks if a visa petition has been applied for before as you say? I do see where it asks on i129f if I have applied but not her. I have not. And on form DS156 it asks if she has applied for an immigrant visa before but the K1 is a non-immigrant visa, right? Maybe i'm just being blind 'cos there's so many forms overall.

Thanks - just to clarify, they did say that all of our paperwork is in order, the only issue is that the previous application needs to be resolved, so they hadn't complained about DS156 Q36.

Well, anyway, thank you for the reply, we'll give them a while to process the case at the USCIS and i'll contact them when they receive the case, but if there's no progress by August our new plan is to switch to CR1. Of course we'll spend the meantime researching to make sure nothing like this happens again and getting the previous fiancee's case withdrawn.

Thanks to everyone for the replies, compared to this time yesterday i feel much more educated, and we won't rush into cancelling the K1 application prematurely, only once we've determined that the CR1 is a definite advantage to us - but i can tell you now that it already has helped lift our spirits to know we can go ahead with the marriage anyhow in a few months, rather than sitting in CSC purgatory indefinitely. I'll search the forums for answers to any new questions i have and post a new topic in the appropriate forum as appropriate.
