Hi,

My son is going to come this summer with a tourist visa, As in April, my ex and I went to court to change the custody, and now I have the custody.

, I am not married, I have the permanent resident card and waived the condition of being married.

So my question is Can he come with the tourist, and once he is here, he stays and apply for him to permanent resident too, I-91 or adjustment of status, I am not sure what is possible.

THank you for your answers

Alex.

You will have to petition for him, assuming he is a child as seems likely it will take 2 years or so.

Using a visitors visa to enter the US with the intent of staying is punishable by a lifetime ban.

Filing for a child of an LPR take about 2 years and overstays are NOT forgiven.

Filing for an adult child take much longer and again overstays are NOT forgiven.

This will not be over quickly. You will not enjoy this.
