Nothing on NVC yet its been 35 days!!!

Ok, so here's an odd thing.... I talked to USCIS tier 2 this morning, and they said that my case hadn't been sent to NVC because it's still being reviewed in AP.

I thought AP happened at the NVC? is this BS?

Call the USCIS again and talk to another tier 2 and you will get a different answer, trust me on this. I just went through the exact same thing. There is no AP being done, it is just sitting there until the next batch of petitions are sent out to the NVC. I got the exact same email you did and I got all kinds of answers until my Senator's aide called the local office directly. Local offices are not used to handling petitions so they seem to have no urgency in getting them to the NVC in a timely manner. That and they for the most part only send their batches out once a month so if they missed one monthly shipment then it will just sit around for another month.

Call the USCIS again and talk to another tier 2 and you will get a different answer, trust me on this. I just went through the exact same thing. Well more is happening now, and yes, I did call back and even the tier 1 I spoke to knew it was BS. Seems like more is happening now, but I won't buy it until I see results.

Heard from the Senator's office that the file has been located today and is on it's way to the NVC.

I hope that's the case...

you should be fine I had the same thing with my senator and it was at nvc within a week and it was just shipped to embassy today.

Amazing case similarities :) So much for AP huh?

Too bad this is starting to become the norm with the USCIS. So much frustration and stress being caused by their unwillingness to pass along the petitions to the NVC in a timely manner. That and their CS reps making stuff up on the fly to placate petitioners is making life miserable for many.

Anyway, congratulations! You should know within a week or so if it arrived.

the posters on this thread are pursuing a k-1, since you are on a cr/ir-1 route, your file was processed differently and by a different divisions.

I had the same problem with my file, you should get an infopass and talk with an IO, your file is still sitting at the same office that approved it

I don't trust anyone in this anymore. If I don't have something in writing, It never happened. I really don't care what people say the "Norm" is, when most cases make it to the NVC within 2-3 weeks. Anything more than that, and something is wrong, and you have to pester the hell out of anyone who will listen until something happens.

I've really seen the change in my perspective since I started this process, and when I see new users saying things like, "It's been a week and nothing at the NVC!" I'm filled with a mixture of laughter and sadness, and I want to give them a hug and say, "You poor thing, you have no idea what it's really like yet, and I'm sorry if you find out."

I been waiting for 10 weeks can i get a hug because im really pissed at USCIS and still waiting ;( lol my case was retain so God knows when it will be shipped out.
