Greetings to all,

Myself and my wife got married here in the USA on October 20, 2012. We filed for her AOS in March 2013 and are expecting her EAD and Advance Parole in a few more months. At this time we are going to plan a trip to the Philippines for about three weeks. My question is can I book an airline ticket in her maiden name shown on her passport going to the philippines and then book her ticket on the returned trip to the USA in her married name? We plan to have her passport changed to her married name in the Philippines because I think this will be a lot faster in the Philippines than to go to Washington DC to the Philippine embassy there. Also If we do apply for a name change on her passport in the Philippines, what requirements will we have to have to accomplish this? What happens to the K1 VISA that is attached to the old passport? Any one that has done this please give me your experience.

International travel documents MUST be in the name on the government issued ID used for travel--i.e. a passport. So the tickets need to be in the maiden name since that is what is in her passport. The name on the GC does not matter until it is time to travel back to the US and board the airplane. You must show that the wife with a passport in the maiden name is the same person as the name on the GC. So it is recommend you carry a certified copy of the Marriage Cetrificate to help the airline people make the connection. Now if you get the passport changed then "YES" her tickets must be in the married name. I would either get the passport changed before you travel to her married name or wait until you come back as I am not sure how you can purchase a RT ticket in two "different" names.

The K-1 visa is a one entry visa and is not valid once she entered the US the first time. IT is not needed. You need to make certain you keep the I-94 justr in case you have an interview and they want it then.

We would be traveling before my wife gets her GC and I think that I can buy the RT tickets in her maiden name going there and her married name coming back. Not 100% certain though. If anyone here has done this please let me know.

Also, since you got married in the U.S. and she wants to amend her passport, you should file a "Report of Marriage" with the Philippines Consulate which has jurisdiction over the state where you got married. It's a requirement for passport amendments or passport renewals for K-1ers. You can do this by mail, at an outreach event, or at the Consulate. All the necessary information for reporting your marriage and for passport amendments is on the Philippines Consulate's website.

Chinook never reported our marriage, never amended her Philippines passport, and never renewed her Philippines passport. Her Philippines passport expired about a week before she got her U.S. passport. Of course, her U.S. passport is in her married name.

I would double check with a travel agent or the airline to make sure this is OK and they won't treat it as 2 one way tickets. Just as an FYI. When you buy an international 1 way ticket (which is how I suspect the airlines will look at the tickets in different names) they will put you in the most expensive fare class. For example if you bought a round trip economy class ticket on Delta you could get a 'T' class ticket (cheapest available). If you bought a 1 way economy class ticket on Delta they will bump you to a 'Y' class ticket (most expensive).

How long are you and your wife going to be in the Philippines?

If your wife gets her passport amended in the Philippines, she still will have to submit to the DFA a "report of marriage duly authenticated by the NSO." I'm not sure if this is something she can do in the Philippines. You might want to check it out in advance. Even if you could do it while you were there, I'm not sure how long it would take.

If you report your marriage to the Philippines Consulate while you are still in the U.S., it can take a few months before it shows up in the NSO records.

Keep in mind that your wife already will be depending on a USCIS letter acknowledging the receipt of her AOS, or she will be depending on her advance parole to get her on a flight and to get her back into the U.S. Counting on a timely passport amendment in the Philippines seems like you're playing with a bigger fire.

I was reading about this too before because that's what I was planning to do the next time I come back to the Philippines.

I think you can book the roundtrip ticket in her married name but make sure to bring copy of marriage certificate to show name change.

I would recommend checking with the carrier. The carrier has the final word on it.

When Chinook was still traveling on her Philippines passport in her maiden name, the carrier required the name on her tickets to match the name on her passport.

You have to do the Report of Marriage Contracted Abroad first. If airline will allow her to use maiden name on ticket, then she can do the renewal of her passport once she's in the Philippines.

For spouse of foreign national:

- Marriage Contract (MC) in Security Paper (SECPA) issued by the National Statistics Office (NSO) or Certified True Copy (CTC) of MC issued by the - Local Civil Registrar (LCR) and duly authenticated by NSO. Transcribed Marriage Contract from the LCR is required when entries in NSO Marriage Contract are blurred or unreadable.

- Report of Marriage duly authenticated by NSO if married abroad

- Original and photocopy of Commission of Filipino Overseas (CFO) Guidance and Counseling Certificate of Attendance (required for first time applicants or renewal of passport to be used for the first time the surname of the husband)

Given that she does not even have EAD yet, why no use the time before it arrives to get her PI passport into married name here in the US before travelling. I would ask the airlines or a travel agent about the ability to get cheap tickets in one name for the trip to the PI and another in a married name for the return trip to the US. I would also see if three weeks is long enough to get a new passport in the PI. After all that I would just get a new passport while waiting as it sounds like you may have another month or two before the EAD arrives.
