Hi everyone,

On December 1st I mailed Our K-1 petition. January 7th Recieved NOA1 and a I-797-C because of the incorrect address. From this point i realized there was a porblem the NOA1 has the incorrect information on it. 100% incorrect names addresses birth dates. From here I make the connection The names look familiar and i relaize that I mistakenly printed out the "Sample form" here on Visajourney i was using as a refrence on how to properly fill out the I-129F and just the first page (the incorrect page) ended up mixed in with the other 2 correct pages.

On January 12th I called and explaned the sitaution. They told me to write a letter of explanation and mail to them. I made 2 calls on the 2nd i talked to a Supposed tier 2 and I updated all the incorrect information person to person over the phone with the supposed tier 2. Also i mailed that letter with copies of the NOA1 mailed a letter of explanation and the correct forms to California Service Center.

January 20th i recieved a Service Request letter with a copy of the incorrect I-129F they have on file. In that it states "Due to the numerous incorrect information contained in your petition, we cannot verify the contents thereof, so we are sending you a copy of the petition filed for your information. Please fill out a new petition, date and sign it and return it to us."

January 23rd i mailed a copy of the Service Request letter and another corrected I-129F again to the address on the letter which was CSC.

February 15th I called to inquire if my new I-129F had been recieved. Talked to another Tier 2 very unpleasent person. She qtold me i had the wrong recipt number because my actual name and that on the recored did not match. So i said yes i know and proceeded to read off the names she was seeing...John Jerry Smith, Jane Joan Doally etc. addresses and birth dates. She told me they had nothing new, no updates. and to call back in another week. Week later called back same thing.

Today I called talked to another Tier 2 explained how things happened..again was confronted with the "this is not your case you have the wrong reciept number. Again i said yes i know and started reading the names she had. She did not like this and insisted she would not tell me any information about the case because it wasnt mine. Told her i had a Service Request gave her Referal numbers ans she said that none of the people i talked to in the past were Tier 2 and they werent to do what they did giving info on the case etc. Awsome. I told her i sent the new corrected petition as requested with copy of Service Request To CSC. She said i should have sent it to Texas Lockbox. -_- Seriously? OK so i sent everything where i had been told apparently to the incorrect place wasting months. Also the S.Req letter says nothing about Texas Lockbox.

She told me to send a Cover letter explaing the sitation that i recieved a case that was not mine. etc.. This is where im a bit confused she implied well really falt out said that i should say that it was their mistake and i had already paid and shouldnt be penalized for that. I dont really feel comfortable with that, it was my mistake i sent that wrong page i admit that, Your opinion? So the list of things to send: Cover letter explaining situation, Copy of the NOA1 and I-797C, Copy of the Service Request and a corrected I-129F.

I'm wondering how i should explain this in my cover letter. It seems extremely difficult to explain to people that i mailed a "sample/refrence page" accidently. Also the for expiration Date on that form are 2006 for that first incorrect page and 2012 on the other 2 correct ones. I was thinking of including a link to that sample form so they can see it, good idea or bad?

Im not looking forward to telling my fiance..she going to be devestated. I think i will have her send all documents with updated dates in preperation for total K-1 melt down. So i can start all over.

Losing 3 mothns is beyond painful I'm totally stressed out i really need help/advice mainly with cover letter.

Want this fast and easy? File a NEW correct petition, pay the fee and get on with it. There is no conflicting petition since there IS NO petition in your name. Just send a new one and eat the cost...call it education expense. The fees in this process are the least of your costs, so it is no big deal. Seriously, you are doing all this to save $340.00????? That is the only benefit you could possibly receive at this point. $340 makes all this go away tomorrow.

Duplicate everything (except the incorrect petition) and send it out.

As for explaining it, good luck with that. Lithuanians, though they are FSU they really are not, if you get my drift. A Ukrainian or Russian woman would seriously question her decision about marrying you. They like men that just kinda "handle it" and do not bother them beyond signing something where needed. Such kinds of actions by the head of the family cause serious soul searching. It is what it is, so break the news to her as you think best.

You are only going to lose more time if you continue to mess with USCIS on the phone. Just ignore any mailings you get for John and Jane Doe and go with the correct names. The incorrect petition will die a natural death when no one acts on it.

Also given the gross negligence of your error (that IS what this is) I have to advise you to carefully read the instructions and make SURE all the other documentation needed is attached to the petition...G325a, letters of intent from both of you, passport photos, proof of meeting in person, proof of eligibility to marry (if applicable), proof of your citizenship

Yeah, i had been thinking about it and decided that a complete new Petition filing is in order as you suggested. As for cost I'm not at all tring to save money that idea never crossed my mind, time on the other hand is precious to me. Yup it was my mistake that caused this, but USCIS was extremely unhelpful by by falsly stating i was speaking with Tier 2 supervisors. A blunt response to send a complete new petition would have been appreciated. The little shred of faith i had in the govt. is gone now i know 100% its not risking ever putting your trust in them.

I already have a complete petition on standy evidence and such, all forms are filled out all just needing signature and the updated date. For her being upset, we have endured much harder things. Yes, she is a hardass and we are both stubborn, but it's just some of the million things i love about her.

I apprecitate finally a staright to the point awnser.
