Hello VJ members! I want to thank all of you in advance for your reply and input. My question is:

What is the probability of a previously filed K1 petition, which was denied, and a CR1 I-130 petition was filed by the same petitioner for the same beneficiary to be placed on AP or denied a visa and returned for reaffirming? The relationship has been ongoing for over four years with daily correspondence. Petitioner has visited three times, met family and friends and petitioner plans to be there for the interview. I-130Petition was filed, approved by USCIS and its at NVC.

Petition was front loaded with evidence of letters from family and friends, pictures and so on, and all the red flags address one by one in a two page letter sent to USCIS. By the way, no NOID or NOIR was received.

Second petition have a higher success rate than first petitions although there have been a few failures. Many choose not to post here after a second failure. AP is more likely, first to validate the relationship that they originally dounted and secondly it is a price Nigeria pays for the actions of the undie bomber and the fool that was sneaking on planes if a gym bag of fake id's.

This will not be over quickly. You will not enjoy this.

It probably depends on why the K-1 visa was denied in the first place.

I agree with NigeriaorBust in the fact that AP is fairly/more likely as it is Nigeria, and for the reasons stated.

AP is more likely, first to validate the relationship that they originally dounted and secondly it is a price Nigeria pays for the actions of the undie bomber and the fool that was sneaking on planes if a gym bag of fake id's.

Basically almost every one said to file a CR1 after our denied K1 but I have always wanted to ask the reasoning.

I think because mainly the fiance visas are denied for lack of bona-fide relationship, or needing a co-sponsor at an embassy that does not accept them. If you marry after the fiance denial you have more time to gather additional evidence, it shows you are still committed and together, and the I-864 financial is enforceable, with or without a cosponsor.

All these things together help make a stronger case when needed.

In most K1 petitions in Nigeria, the CO says there is lack of bona-fide relationship, or it is for immigration purposes. If I knew what I know now about Nigeria's process, I would of never spent my money or time or energy with K1 at all. I would of used that money to make few more trips and enjoyed being with my man, and then married him and came back and bypassed the "%$#@#" :angry: that comes with this VJ and just filed CR1 when good and ready. So much energy and time is lost....

At least with CR1 or I-130 one can reaffirm, if it is sent back. With K1 they just let the darn thing sit on someone's desk and expire. When it is finally sent back to the US nothing can be done to reaffirm the petition. It is a lost cause.PERIOD.

In our case it was not because I needed a co-sponser or lack of relationship. It was the fact that when a petitioner follows the instructions of filing given by USCIS, without having access to a group such as this (VJ) with the eye opening information and reality of what visa journey is really like. A petitioner doesn't know what is ahead or expected by the Nigerian US CO "THE GODS OF VISA" at an interview. When a petition is not educated on the facts and the truth and is approved here with minimum evidence at first and then sent then the petition is sent to Nigeria,we assume that the evidence which was provided was enough for the US therefore it is sufficient enough for the remaining process. OH BOY that is the farthest thing from the truth...reality hits like a brick wall :bonk: when a fiance goes in for an interview and is giving the ax. :rolleyes:

In this process there are many loop holes as we have discussed this many times in the past here on VJ. Also, those with ill intentions have created a much harder journey for those who are legit.

The second time around one becomes wiser, humbler and more prepared for what is ahead. As the saying goes "live and learn"...ultimately this is a marathon and not a race...one must do it gradually and with knowledge which the members here provide.

I wanted to post this subject because it is a fact which some if not most of us are facing. I hope we get more input and insightful respond. Thanks for letting me share my views.

My then fiancee now wife K-I petition was denied after the officer viewed our engagement pictures. The interview officer told my fiancée that our wedding was too extravagant and our engagement is consider a traditional marriage under Nigeria law. she issued the denial letter with that reason and advised that I should file CR-I petition for a spouse. K-I petition received more denial in Nigeria than any other countries.

You are not alone. There have been many couples who were denied for the same reason. Engagement celebrations could come across as a traditional wedding if it is over done. K-1 petitions are denied more so than approved in Nigeria. As I found out when I first joined VJ that the US Consulate in Nigeria is the toughest one to deal with. Info I learned about too late. Still, one lives with hope that in time this too shall pass.

I just found out that my petition was transferred to Los Angeles Field Office which means it could take longer than the approximate five month processing time for CR-I. Now, I am looking at possibly twelve months processing time due to large immigrant population in Los Angeles. I need all the luck I can get with this snail craw processing.

Thank you LoveNigeriamostyle. My petition for the CR-I is already three month in the pipeline now. I just found out that my petition was transferred to Los Angeles Field Office which means it could take longer than the approximate five month processing time for CR-I. Now, I am looking at possibly twelve months processing time due to large immigrant population in Los Angeles. I need all the luck I can get with this snail craw processing.

Ours took 8 months with USCIS just recently it was approved and sent to NVC. Patience is essential in this journey. It seems all the government offices are cutting back with staff regardless of the millions they are making out of us petitioners...hint hint ;-)

Keep focused and don't get discouraged or side tracked. This too shall pass and become a memory one day. Wishing you all the best!

I wish you the best this time around Nigarmostyle and I wish we could have done a CR1 the 2. time as well but instead we find ourselves repeating the K1. :bonk:

I see that the USCIS also calls some petitioners in for interviews in field offices. K1's are currently moving 7-9 month in processing time. Gee whiz ! I have seen CR1's flying through with 2-4 months.

Anyway, best wishes for a speedy interview appointment which "may" be in May for you :)

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Thanks Ebunoluwa. I know this has been a long journey for you as well. As Nigeriaorbust indicated, second time around might be easier. What else can they take away from us which they already have not? :bonk:
