Hi there,

Working on getting our paperwork in order for the next stage of the process while CSC are working extra hard to get caught up ;)

I have a few questions regarding the I-134. I am the beneficiary. I have three kids, ages 19, 9 and 7. Only the two youngest will be coming to the US with me. I do not pay child support for my eldest, he is supported by his father and lives independently in his own home. Do I have to include him on the form? The question (3) specifically says: 'Name of spouse and children accompanying or following to join person.' So, my guess would be no, but I've read other things on this forum so just checking!

Secondly, my fiance has two kids over the age of 21 who are fully independent. I am assuming they do not need to be included? He has one child who is 8 yrs old who lives with her mother and for whom he pays child support. Does he tick 'partially dependent' for her?

So, I knew there was something else! When we are looking at poverty levels does it need to be for a household of 4 (me, fiance, my two kids who will be living with us full time in the US)? Five (to include his daughter), or six, to include my eldest who will be staying in the UK and is not dependent on me financially?

Or will the CO look at the whole situation other than is on the form and not go by poverty levels?

Anyone? Anyone? Bueller?!

- On the I-134, based on wording, you only list the kids that will come with you, ie your two younger kids (on the I-129F, you list all of them). No need to list adult kids, ie your fiance's adult kids, but he should list the 8 year old as he is financially responsible for her, and would be even more so should something happen to mom.

- Household will be 5.

- For a K1, the CO technically has some leeway in determining poverty levels, but for the Adjustment of Status after you marry short while later, the absolute minimum is 125%(they cannot approve under, but they are not obliged to approve over if the income is temporary or you just scrape by), so most embassies use that.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I suspect you could file a change in your older tax returns, and remove the two kids over 21 from them. That might help.

And what would that accomplish?

The older kids are no longer dependent and no longer included in the household size. Household size is still 5.
