Hi my husband is filing his taxes from abraod for the last 3 years. Doesnt owe money so its fairly straightforward. We were not married in 2009 so is filing as a single person. On question 12a it asks did any of your family live with you abroad during any part of the tax year? Does he answer yes even though he is not claiming tax credits for us on his 1040? if he answers no then that is not true.And if he answers yes what does he put in 12b ? Partner and 2 kids,spouse and 2 kids or common-law wife and 2 kids etc.... thanks for any help on this

Hi there! not sure if you got this answered yet but my best bet would be to put yes down and just list his children. I don't think he should list partner since you weren't married. But I don't know for sure! I only just realized myself that I needed to file taxes while living abroad! hope you got it sorted anyways

10/1/13 - Received Documentation of Approval

8/8/13 - Visa Interview
02/19/13 - Sent I-130 to Chicago Lockbox
02/28/13 - I-130 delivered
03/01/13 - NOA1, routed to NBC
03/12/13 - NOA1 Hard copy received
04/10/13 - NOA2, received approval confirmation by telephoning USCIS and case/approval finally showed up online

04/25/13 - NVC received case

Hi there! not sure if you got this answered yet but my best bet would be to put yes down and just list his children. I don't think he should list partner since you weren't married.
