Can USC send DS-3032 and DS-230 Package As Agent?

Can USC send DS-3032 and DS-230 Package As Agent for His Parent?

I've just recently started this process, and am still waiting for I-130 to get approved for my mother, who lives abroad. I am still figuring out all the steps involved, and just when I think I got it, something else confuses me!

Originally, I though my mom will have to file DS-230 with civil documents at the local embassy.

I kept reading the extensive guides here for the CR-1/IR-1 applicants. Then I learned about the DS-3032, and we decided that I'll be her agent and send all the papers from here. We felt it would be more reliable if I am sending documents directly here from the US.

But the guide for parents of USC is very limited and stops at filing the I-130. All it says is that after I-130 is approved, the "parent will be notified to go to the local U.S. consulate to complete his or her visa processing."

So, now I am super confused!

Can I, or can I not, act as mom's agent, and send DS-3032 (via email) after I-130 is approved, and DS-230 with civil documents after I-864 is paid and received?

Anyone here who filed those papers for their parents?

Or can only those filing for a spouse take advantage of acting as their agent?

It doesnot only apply to spouse. The petitioner can be the choice of agent in all instances.

Petitioner LPR upgraded to USC June 22, 2012
August 22, 2012: case complete
October 18, 2012: Interview (APPROVED)
October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)

Timeline

If you have a signed DS-3032, you can send that in to NVC.

If you have a signed DS-230, you can send that in to NVC.

as for parents, they mirror spousal stuff 100 percent.

I think the OP is asking if he can email the DS-3032 instead of his mom & assign himself as the choice of agent.

I would email from mom's email address, and put myself as choice of agent.

My question is, is US-based agent, in general, a valid option for IR-5 applications, regardless of how DS-3032 is sent (email or snail mail)?

This agent would later send DS-230 with original documents, instead of beneficiary having to bring those to the interview - like official government page says.

Any USCs here who filed for IR-5 for their parents?

It is a lot easier if the choice of agent is here in the states. Most of the members here in the forum chose their US-based sponsor/petitioner to be their agent.

Below is a quote from the NVC letter regarding the choice of agent.

"NVC strongly recommends choosing a person with email capability and a postal mailing address in the U.S.A. "

I am filing IR-5 for my parents. I am currently waiting for my mom's case number. My dad has case number already. My parents are gathering all their documents & will mail those to me. As soon as there is a case number assigned for my mom, that's when I will proceed with the assigning for choice of agent, paying the AOS fee ($88 for both), mailing the affidavit of support, pay the IV fee ($230) and mailing their DS-230 packet (civil documents).

i filed for my mom last year and I used my email to choose myself as her choice of agent. I didnt have any problem with NVC doing that.

You can have your parents signed the DS-3032 forms and selected you as agent. Another quick way is to send the Email format of DS-3032 from the beneficiaries (parents) email to the NVC. Once it's approved, you will receive instructions to proceed with their DS-230 package.

It seems it's safe to say we can proceed with our plan; me keeping the doc originals, mom having a copy (for just in case) for the interview, me emailing DS-3032 and DS-230 (I have signed versions of both), and mom just waiting for the interview scheduled call and go do the medical.

I was just confused because some folks were saying she should send the ds-230 with doc originals, and even one, probably old, page from our local embassy said that she should not send the documents with ds-230, but bring them to the interview.

jc_colin, I see that you talked to an ISO to find out that your case was transferred to a local office on Nov 28. How did you get CSR to transfer you to ISO? When I called and said I want to see if and when my case was transferred, she said that was not reason enough to transfer and that ISO would not accept to take that call. I said to at least try and see if they accept, and she said she can't do that.

She, of course, knew nothing about I130s being routinely transferred, that online status doesn't reflect that, and that local office doesn't notify us of the transfer nor report processing times.

Should I just keep saying "I know you have to transfer me if I request an escalation?"

Thank you! That did the trick. :)

She was still annoyed when I interrupted her little spiel of all the ways (email, leave a message...) I can contact them, and said "I'll wait" after she said "or you can wait on hold until they answer". She asked me to let her finish her sentence!

After a 40 min wait, I was able to speak to a very pleasant officer who was in no rush to explain things. Unfortunately, unlike their website, he said 6-8 months is the expected approval time - although I think he is just being on the lets-give-the-max-time-so-they-get-pleased-with-us-when-it's-less side. And that's for any immediate family based petitions.

He also said that no all cases are transferred from NBC to a field office, that they do send out courtesy notice if it is transferred, but that the online system doesn't always reflect the "touch" date or transfer (they are working on it).

I didn't expect much out of this call for our case, anyways. I know it's too early, even for a transfer, which he confirmed, and said if it does get transferred, it will be close to 3-4 months (again on the conservative side, I think). I'll give them a call in couple of months again. At least now I have the experience of how to get through!
