Timeline

So here it goes, I (Navin) filed the petition for Hubby (Fahad) in August 2012 and received NOA1 around the same time (See Timeline). I have not yet received my NOA2 (Just like the rest of you lot). I came to Pakistan to be with my husband in October 2012 and currently living here. I check the case status daily but sigh!! no change. I have called customer service 3-4 times during the span and they tell me that I might have an interview in Houston (my residing city) by February 2013. The issue is that I am living in Pakistan and will not be able to make it back if they call me for an interview. I am stuck in a limbo also because if I make it to the interview they will ask about my pay stubs and prior employment which I don’t have since I quit my work and went to Pakistan. Either way they will delay my process since I am unemployed and wont be able to have a co-sponsor. What to do, What to do. Advice Please. Let the discussion Commence

21st August 2012 I-130 packet Received Email confirmation
24th August 2012 NOA1 received email and mail - petition transferred to Lee's Summit, MO.
4th September 2012 NOA1 status on USCIS, case transferred to USCIS office
Update: 11th Nov 2012- Found out case is in Houston Local office since Nov.

April 15th 2013 - I-130 Approved (NOA2)

July 2013 - Petitioner (wife returns to the US) and starts working.

September 2013 - Decided to file with NVC.

October 2013 - Submitted DS-260 got approved.

November 2013 - Submitted civil documentts IV packet.

December 2013 - Received email from NVC that documents are complete

January 17th 2014 - Interview - Put in AP for 1 to 3 Months.

I don't know what to do about the interview but I am 99% sure you will have to have a Co-sponsor at the NVC stage.


USCIS - 66 days ROC - 139 days from sent to approved
12/3/2012 - I-130 delivered to Chicago 5/20/15: mailed I-751 package to California office
12/4/2012 - NOA1 NBC (Missouri Service Center MSC) 5/22/15: Date on NOA1
12/6/2012 - Check cashed 8/26/15: Bio appointment

12/8/2012 - Received paper NOA1 10/06/15: Received Email card was being processed
12/20/2012 - Case number showed up on USCIS website
1/29/2013 - Called USCIS and case is still at NBC
2/8/2013 - Received an Email that we were approved on 2/7/13
3/5/2013 - Told file may have been "misplaced" to email NOA2 to NCVresearch
3/7/2013 - ISO at the USCIS opened a service request to try to track down
if and when the file was shipped. Should hear something before 3/26 ( so she said)

03/11/2013: NVC received (31 days from NOA2 at USCIS till received at NVC )
03/25/2013: NVC Case no. assigned

Without either the primary sponsor (i.e. you) or a co-sponsor who makes over 125% of the poverty line for your appropriate family size then your application will be denied.

i say get an ISO the next time you call, and ask for casefile status and location.

Then ask if you have been pegged for a local interview or not.

Then let us know !

Alright got that, but what if we dont have primary or joint sponsor and my wife is unable to travel at the current time. Is application denied completely or can you show that you have enough money to start your life in America, or will it be imperative for the wife to go back and work for a few months.

i say get an ISO the next time you call, and ask for casefile status and location.

Then ask if you have been pegged for a local interview or not.

Case file in Houston office, the ISO told the wife that she may or may not have an interview, was not direct.

The petitioner is always the primary sponsor, but as I said above, if the petitioner does not make enough to meet the guidelines, and cannot provide a co-sponsor who does, then the application will be denied. The affidavit of support is not optional, it is a requirement.

hmm ok. lets say we get the NOA2 tomorrow, how long can we take to go through the NVC process ? Hypothetically wife goes back lets say end of march, gets a job makes good enough (when she was working in america she was making well above the poverty line)... OR is there a specific time period that we have to submit the docs by lets say end of Feb or something ?

hmm ok. lets say we get the NOA2 tomorrow, how long can we take to go through the NVC process ? Hypothetically wife goes back lets say end of march, gets a job makes good enough (when she was working in america she was making well above the poverty line)... OR is there a specific time period that we have to submit the docs by lets say end of Feb or something ?

you have a year at nvc until you need to say something about keeping your petition open.

if wife gets job in march and you submit aos in june, could still get denied.

up to the discretion of the approving officer if they find a few months sufficient.

at NVC.

at NVC.

Interesting point on the cash assets, lets say we have somewhat 1/3rd of that and the wife is working. Ah well its gonna get too technical now. She has worked only 4 months in 2012 but regular before that plus we have someone money saved up, then what ?

Wait i am just figuring this out in my head, last 3 years that would be 2010,2011 and 2012. We have enough for 2010 and 11, and lets say some money required for 2012 and 4 months of work which would be good but not that close to the requirement of I864 for 2012. So if she works a few months and is good with 2012 and meets requirements after doing the math, do we get approved ?

Hey! I got married on July 3rd, 2012 in Karachi Pakistan :) just a day before you. I also filed I-130 in August. I got my NOA1 a week late but Im still waiting for my NOA2. InshaAllah it will be approved and will arrive some time this month. I called them yesterday and talked to Vermont service center lady. She told me to wait another 30 days and I should get something :)
