No, they will just ask both of you to attend (which they usually do anyways).

How to make out whether its stokes or not?

What would happen to EAD?

What exactly is the difference when Reason is Interview regarding your pending I-485 application Vs Reason is Interview regarding your pending I-130 application? Mine is pending I-485. Does that mean I-130 approved or what?

AOS (from H1-B) Timeline:

Day1 -- 09/23/2012 - 130, 485, 765 AOS package delivered to Chicago Lockbox

Day4 -- 09/26/2012 - Emails/texts acceptance confirmation in evening :-)

Day5 -- 09/27/2012 - Checks Cached

Day12-- 10/01/2012 - Received hard copies of NOAs for I-130, I-485 and I-765

Day16-- 10/12/2012 - Received Biometrics Appointment(appointment for 10/24/2012)

Day16 - 10/12/2012 - Biometrics Walk In - Refused

Day20 - 10/16/2012 - Biometrics Walk In - Successful :)

Day33 - 10/29/2012 - EAD card Production Ordered-Pleasant surprise :)

one of them already had a pregnant wife at the time of 1st interview and his 2nd interview was just to see if everything was still the same, the other one was a straight up stokes. Hope this helps!

@greenie80: I know how you might be feeling now. But as 'AnotherLostSoul' said it could be due to red tape or some other silly reason. Who says one can't marry twice or thrice.

Just keep faith. You'll be fine soon.

But its' going to be over 7 months since your first interview. Now its time to wake them up.

You can't pay the price for somebody's inefficiency.

thanks for the reply. Unfortunately it's not due to carelessness in our part since for the past 5 months we have been proactive in doing infopasses and spoken to the branch supervisor plus another supervisor to try to find out why it's taking so long. We have our congresswoman checking on the case every month and the response is that Oakland Park doesnt have availability for 2nd interviews. We have also set up 2 Service Requests and the office said that even though the letter we received says we will hear back regarding the next step for our case in the next 60-90 days, that is just a standard letter they send out because most cases are resolved in that time frame but in our case and many others at our office, we just have to wait because the office is extremely busy and they are even working the weekend. Yeah thats our government

1. You won't know till you get there. Prepare as if it is and go from there.

2. Depends. If they take it it usually means you're approved. But if you want to keep it for employment reasons until the GC arrives ask them to keep it. Often you'll not be asked for it. If you're denied the EAD and AP are cancelled.

3. Would make sense given you can't AOS without an approved petition.

2. If they want to Deny, they do right away or they send first letter of intent to deny? I guess even if they deny at the spot, you've 30 days to appeal, right?

3. I guess Mostly its I-485 has problems not I-130. How you observed on this site, they usually approve both at same time

(when filed together, and both are approvable)?

4. What are possible outcomes after Stokes interview and what can be done for those?

Hmm......they never took my EAD at the interview...indeed, they did not even ask for it. I don't think I actually even had it with me....and I still have it...and it's still valid...;) So I can double work now? *ouch* :)

Some have it taken, some don't.

It's also no longer valid (even if the expiry date is still current). If you tried to work on it you would be flagged because you have a GC and should be presenting it, and presenting the EAD would make them think you've given it to someone else to use. In fact, I don't think it would return a "work eligible" if entered on the e-verify site.

The website is often unreliable. It could be it hasn't been approved and they're doing both at the interview. It could be that it's been approved and you haven't received the mail yet. Honestly I wouldn't worry about that part.

Simply prepare for a Stokes and see how you go.

Just to compare my i-485 online status is "interview and testing" but my i-130 is still in "review" , but so is my AP and I have my EAD and AP. I think they will adjust the i-130 to approved when they adjust the i-485 to approved.

Are you sure they called you 2nd time b'cos you were out of status? Out of status is forgiven in marriage cases.

Did they mention this on paper or told you specifically?

For my further review, i am not sure about reason as IO didn't mention anything, nor on the paper :unsure:

No they don't. It i a little more likely (as they may suspect marriage only happened to keep the OOS beneficiary here), but plenty of people get one easy interview, if they have a lot of bonafide evidence, and get approved.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

So, please remove from yr mind that they're going call u again for just being out of status.

As mentioned earlier to you, they have mentioned noting to me for 2nd interview. Infact IO was quite satisfied with bonafides/other docs.

At the end that ugly letter "Further Review" :crying:

Please post yr interview exp. Correct your timeline/category as it says CR-1 etc.
