Petition Returns To USCI From NVC

Timeline

On 12/13/2012 I received a letter form USCIS of approval and petition was sent to NVC. Today I received a letter from NVC that my petittion was sent back to USCIS on 12/26/2012. There is no reason given as to why it was sent back. The letter also assigned a NVC case number. I read the forum and it seemed most petition denials were after having an interview. Can anyone give any feedback on this case. This is so stressful..Thanks for reading.

What kind of Petition did you file for?

I know this happened recently to a member they were waiting for case complete at NVC and case was sent back to USCIS. But in their situation it was because they had cancelled their K3. So confusion started and well now their case is back with NVC and they are waiting for interview date.

My petition was I130 for my spouse..Thanks dwheels76 for your feedback. Does it seems odd to you?

I had never heard of it until my friend told me of hers. Than checked around and people have had petitions returned because adjudicator forgot to attach a paper to file. Like what in the world.

And I am sure you are getting the run around with we don't have it, we don't do that. It took my friend over a month to finally get USCIS to say we have it and than say what was up. It was sent back in October finally got back to NVC this month.

So odd. Yes. But its Immigration what can you say. Nothing is normal anymore for us all. ;-)

I hope you are right .. My only other concern is my identity was stolen a few years back and the guy committed a dui and other petty theft using my name and driver lisence number. The thing is whenever my name is run through the fbi data base, I'm clear but the local police data base would link me to him. I reapplied for a passport last year and was given one so I don't know what to think..BTW, dwheels76, I'm also in Houston Texas..Life would be simplier if we just fall in love with an American woman... :D

it's rare, but it happens.

NVC will do some review, and send it back to USCIS, as something was missing from the casefile.

Hard to know what's what, without using a telephone.

Call into NVC, see what's up.

Call into USCIS, get an ISO, see what's up.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

A little clarification. I haven't file any forms with NVC, this is the only letter from NVC. I haven't gone thru paying any fees or filing ds-230 or any forms. I'll call on Monday and hopefully get an answer but the waiting is nerves wrecking..

Call NVC this morning and the operator will not give an answer as to why it was sent back. She also said to wait for two weeks before USCIS will receive my paperwork. Anyone here knows how you can get a straight answer form NVC. Wouldn't there system indicate why it was sent back?

No they may never put in why because its USCIS requesting the Case file back. You have to give it some time to get back to USCIS and than received and entered than you can find out the why and what to do next. Sorry but you will just have to be patient.

But do keep calling USCIS and ask for a Tier 2 Supervisor.

If NVC sent it back to USCIS, then there was a problem with the adjudication of it. Wait for a second NOA2 from USCIS, after they have re-adjudicate it. The wait could be 4 weeks or more.

Could be something simple, all you can do is wait now. The blessing will come once it is back at NVC you might be able to request an expedite for the interview date.
