Our case was at the NBC and it seems it never went to the local office.

I just received in the mail I-797 NOA on the official form AND NOA form from the local office (no form #).

So, our case seemed to have been transferred to the local office after all.

Yes, this time I received two separate mailings, but only one was form I-797. That one is from the Department of Homeland Security, USCIS.

The other one, from the local office, says US Department of Justice, INS at the top. It is titled Notice of Approval of Relative Immigrant Visa Petition.

I call USCIS customer Service I was told to wait in the mail early may..

I am sorry that you are still waiting. Only 50% of mid-December petitions have been approved by now. I hope they pick up the speed soon.

My guess is as good as anyone else's. And it's the same for that person you talked to - that is just their guess. They don't have access to your case, they are just reading the same information about your case that you can see online. They probably said beginning of May because that would be 5 months wait for you, and it's their goal to complete all cases within 5 months, although that's obviously not the case for everyone.

By the way, you didn't say anything about which visa you are pursuing, and where your file is currently, and those are additional factors in the timeline for approval.

You might be able to get some more information if you speak to the Tier 2 immigration officer, but don't get your hopes up too high. Here is some info on what they can and cannot do:

You'll probably have to give Tier 1 person a reason why you want to talk to Tier 2, but you can for example just tell them you want to find out if your case was transferred to a local office. Tier 1 doesn't have that information, and would need to transfer you. If you find out your case is indeed at the local office, you can choose to do an info pass to that office to try to find out more info from somebody who actually has access to your file.

Think positive, not RFE, and especially not denial, and start preparing for the next steps.

USC. Filed i130 for husband dec 13th. approved march 25, received at nvc april 8, still waiting on NVC for visa number.
