Now back to the OP, I'm not sure there is enough background info in your post to precisely provide a good advice. Can you expatiate further, as others have said and hopefully you will get some answers. For eg visa type, when case filed, category, date/year case filed etc etc :ot2: :ot2: :ot2:

my category is f4 my case was file in april 2001

What type of visa did you use to enter and live in the US?

It makes no difference how she entered, on what visa or even EWI; her petition was filed before the cutoff so she can pursue a 245(i) adjustment, provided she was physically present in the US on 21st December 2000 and can prove as such.

You should bear in mind that there is a $1,000 penalty for adjusting in this way.

Not exactly...A good professor who understands that knowledge is NOT absolute/perfect and that we are all striving for 'perfect answers' will give the student 'credit' for at least trying! That's why there is the 'curve' in grading.

So close counts? Not in immigration.
