we could get married, we already talk about it. her parents know im illegal and so does she, but i want to get a job now so i can have a resume. i wanna go to college too specially because she talks about having kids with me and a house and all.....

You're only 16. Don't made a sorry situation worse by getting married. It won't help.

Let me do the math for you. Your mother files the I-130 now as an LPR. In about two years you will be scheduled for an interview in Columbia. You will not have a ban since you have not been in the US for 6 months past your 18th birthday. You go to Columbia, do the medical, interview, etc. and obtain your visa. You return to the US legally with all the benefits of an LPR.

Your frustration is misguided. No one here made you overstay your visa. Your frustration should be addressed to the responsible persons. I know that as a teenager you want to be "normal" and if you had been brought here legally life would be very different. This is not the case and you should address the issues that you can, not weep over what has already been done.

It is true that generally, only US Citizens and LPR or green card holders can join any branch of our military. However, under the EO issued 6/15/2012 relating the Dream Act, it IS possible children brought here illegally (as in the case of the youngman) to join the Army or any branch of the military and/or to enroll in college to have a path to obtain citizenship. My earlier suggestion was for him to explore that option.

Dream Act wasn't passed. Deferred action was given via Executive Order. It is valid for 2 years with the "possibility" of renewal. It has nothing to do with citizenship or gaining citizenship.

"Individuals who demonstrate that they meet the guidelines below may request consideration of deferred action for childhood arrivals for a period of two years, subject to renewal, and may be eligible for employment authorization. Deferred action does not confer lawful status upon an individual. In addition, although an individual whose case is deferred will not be considered to be accruing unlawful presence in the United States during the period deferred action is in effect, deferred action does not excuse individuals of any previous or subsequent periods of unlawful presence."

If he qualifies for deferred action will depend on exactly when he entered.

OP, you don't have to return to Colombia. You just need to leave the US prior to 18.5 years. Your mother should have filed for you as an LPR the day she got her GC but she didn't. There are plenty of other countries you could live in temporarily. Consider another country in SA.

I agree that you should consider applying for deferred action for youth (DACA) while you are waiting for your appointment in Colombia. You could do this right away, actually. This would protect you from deportation and allow you to study or work while you are considering your options and gathering more information.

you guys just dont know how horrible it is, my GF is getting her drivers permit and shes gonna drive me around because i cant get mine because im undocumented.

i cannot help my mom pay the bills and i have to rely on her whenever i need money to take my GF out

Actually, a really large portion of the people on these forums know exactly how this is. If jobs were so freely offered, we wouldn't need a sub-forum for finding work. A lot of us have experienced long (very long) stretches of unemployment and not being able to help with bills for our spouses, or even children. A lot of us also came either without a license, or had to go through the papermill to get an American license before we could drive. Some of us still don't drive. (Personally, I'm going on year 7 of my husband driving me everywhere. I'm hoping to get my license within a month or two.) People are trying to help because they DO understand.

Its unfortunate but your best bet prob would be as Life Journey said which is to return home and wait. EVERYONE has/had to wait. Fraud will get you no where but a bunch of headaches. And you saying people in your family commited fraud isnt a good thing to post here as you never know who reads these post as they are public and you never know if it will come back and bit you in the butt one day when or if you do qualify for any immigratation status. I personally do not support fraud. I report what i see or hear because its already TOO hard for those that do it the right way. Just breathe,relax and do it the right way. I love colombia so I do not know where you are from in colombia but Ive been there many times and stayed many weeks.No where is truly 100% safe. its just depends on what you surround yourself with. Think about what can happen with everything doesnt work out. good luck
