Hello,

Please reply/comment if you understand what I should be doing. I am at the NVC stage and waiting to send my IV & AOS package in. I meet all the requirements and well over the poverty line for the last 3 years (most recent being 2011) but I have been jobless for almost all of the year since February 2012 now. I just got a part-time which will only end up being about $20000 annually.

My issue is:

I petitioned for my wife and we had a son 3 months ago. I already applied for his CRBA and they have an appointment next week to get his passport and CRBA certificate.

Do I include my son in the I-864 or the exception rule applies to him (http://www.uscis.gov/files/form/i-864instr.pdf on page 1)?

If it applies I believe I will be good for the I-864 since I will only be sponsoring my wife. If not will I need a co-sponsor since it'll be 3 month old son, my wife and myself?

Sorry for my somewhat confusing question.

Your son is exempt from needing this form, but not exempt from being included in your household. So your household will be 3, you, your wife (immigrant), and your son. So yes you will need a co-sponsor.

Clarity has arrived. Thanks a lot. I guess I'll need a co-sponsor then because I won't qualify with the 20000 USD project income on the part-time at least until I get something different?

What about the co-sponsor? Does he have to include my son when sponsoring? Does he include my son in the I-864 as well? Please advice. Thank you!
