No offense guys, but the judgement to rush to marry while K-1 petition is pending seems like misjudgement in my opinion. You should have wait and finish your k-1 petitioning and get marry when your fiancee finally arrived in the U.S. Both of you would have to start all over again in the petitioning process, and will be expecting a lot of delay, time consuming, fiancial hassle, and a lot grilling during the interview. USCIS will take a lot of time to review your paper work this time, due to short timing of your marry while K-1 petitioning is pending.

Anyway, Good Luck to both of you and congratulation on your marriage.

They have approved us though we dont have letter of intents, no pics together, my visa photo on bond paper and some other mistakes on hubby's (fiance before) bio info.. GEEEEZZZZ.. idk how did this happen.. im really expecting RFE why hubby flew here suddenly and just got married on oct 9th... lol..

anyway, to those VSC filers who have been impatiently waiting, we are MAY filer... :P VSC is moving forward cheers !!!!

Post Decision Activity

On October 25, 2012, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

Congratulations! But now, another WAITING time begins. You should've just waited for the K1 interview. I know for a fact that K3 visa is long than K1. But there's hope...you can ask to have it expedited using your husband's military status (i.e., if he's about to deploy) My fiance did that. And our VISA was issued in just 77 days from the time we filed our I-129F.

we have talked with uscis and they said there will be no conflict.. our k1 will just be automatically terminated.. we have sent though our k1 withdrawal and also sent in our cr1 petition.. we got the noa1 (confirmation email) yesterday... in the cover letter my hubby stated that we have sent a request for withdrawal of our k1 coz we got married..

Another thing..since your now husband is in the military, I'm wondering whether he went the right route. As military members, they are REQUIRED to request their command to marry a foreign national.

I hope he did, because it may put him in a bad predicament. Ask your husband if he did. If not, he needs to contact his LEGAL OFFICE.

every uscis agents that my hubby have talked said that there will be no conflict coz he just married me.. and even before we decided to just get married, he asked uscis and they said if we got married, it will just terminate the fiancee visa.. it will just cause conflict if he got married to another woman while he has a pending k1 petition.. uscis agents even congratulate us our marriage.. they didnt even told us to mail a withdrawal letter because they keep on telling us that there will be no conflict.. its me and my hubby's decision to still inform the consulate that we got married and wont pursue with the k1 anymore but do the spousal visa instead...

we knew even before that its a requirement why we were not able to get married last march before he got back to us.. but then, i knew people from military who didnt ask for commander's approval and still they had no problem at all... :)

with those mistakes and lack of documents in our packet, we are really not confident that approval will happen this soon.. if we are confident that we can be approved without RFE's, we surely just wait for it... but then, we dont want to risk knowing we have those mistakes and since VSC is doing really slow before hubby came here for the wedding... even responding to RFE's will take time.. and also i worry about my medical.. and the fact that we can expedite the spousal visa this time under military reason, waiting time for k1 with RFE and doing the spousal visa in expedite processing will almost have the same time of waiting.. bottomline is at least were finally married and my family here have witnessed our wedding... NO REGRETs.. ;)

Dear VJ members, look at her timeline, they have filed for CR-1 Spouse , she is just letting us know that VSC is moving fast, she knew that she won't be using the K1 NOA 2 anymore, she is just letting us know that VSC is going fine now. in her recent petition , they have transferred them to NBC

even though you guys were approved but it doesn't matter now you have to start the petition all over again and file the CR1 now.

They put their timeline down below. They already did file the 130. But they never cancelled the I-129F it appears. So it is crossed in the mail so to speak.

hey how does it happen that, you guys aproved tho you gys know u got mistakes for the first time. wow.,..And I think The time that you guys married was also ah... hmmm I dont want to say it but guys, I think,,,, you must cancel it then and start new!! for a spousal visa. anyways if you're still going to continue it,, THe CO will definitely denied you application and It might cause you a problem too when youre going to filed for next...

i honestly cant believe it as well that they approved us.. lol.. and i DIDNT said that we are still going to use the K1... We already filed for CR1... :)

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I agree with MrsOyetunji. She is only trying to advise people that VSC is in fast process for those who are waiting. Too many unnecessary opinions here sometimes.
