how to cancel the k1 petition at uscis stage?

we want to withdraw our k1 petition coz we just got married last oct 9th and want to start the CR1 process now.. anybody who had done this? need help.. thanks

err.. sorry, i posted at the wrong discussion thread..

OUR K1 TIMELINE

03/09/2012 Sent first I-129F while deployed at Korea.. He only sent the form so we have to send it again.. lol

04/24/2012 Send second I-129F

05/01/2012 USCIS acceptance date routed to VSC

05/12/2012 NOA1

10/25/2012 NOA2

CR1 JOURNEY

09/26/2012 3rd visit

10/09/2012 Wedding

10/20/2012 I-130 Sent to Chicago Lockbox via UPS

10/22/2012 Filing Date

10/25/2012 confirmation email and text ( MSC )

10/26/2012 expedite request

10/31/2012 NOA1 hard copy

11/02/2012 NOA2 yay !!!!

11/05/2012 Case sent to NVC

11/13/2012 Case number/IIN assigned

11/16/2012 AOS fee bill and DS3032 ready

11/19/2012 AOS paid

11/20/2012 AOS shows paid/DS3032 sent

11/30/2012 AOS package sent( delayed coz of hubby's itrs grrrr...)

12/01/2012 DS3032 accepted

12/02/2012 IV fee bill ready

12/05/2012 IV bill shows paid

12/06/2012 IV packet sent

12/20/2012 case complete

01/15/2013 interview date scheduled (feb. 6, 2013)

01/22/2013 1st day of medical exam

01/23/2013 passed the medical exam !!!!

02/06/2013 VISA APPROVED !!!!

02/09/2013 Visa on hand

02/17/2013 POE Washington Dulles

02/19/2013 Immigrant Fee Payment (165$)

Your I-130 was approved in 2 days from your NOA1 date.

Write a letter and fax it or email it to the embassy then send it snail-mail.

You can do the same to notify the USCIS but since they're already done with your case since it's in the embassy, not sure if you need to do this.

You can notarize it in your bank.

Letter can go:

US Embassy in XXXX

I hereby notify you that I no longer want to proceed with the processing of the fiancee petition - case number XXX000000, beneficiary name XX, DOB XXX, address XXXX.

Signed

petitioner.

For USCIS, notify them you are "withdrawing" the petition. You could simply include a copy of that letter faxed to the Consulate's IV unit..

I did the above and sent it to the Service center via FedEx. I got no response. I sent it again via us mail and still got no response . I called customer service and spoke to a tier 2 supervisor. The supervisor advised me to send an email to ncsc-customerconnect@uscis.dhs.gov I did this and after 3 weeks I got a reply. They had opened up a service request for me and provided me with a case#. They instructed me to send a hard copy of the same information shown above and reference the case # they provided. I was to send it to the service center again. I sent this in by regular us mail but in 10 business days the service center sent me confirmation my petition was cancelled.

thank you for the info.. we were instructed to sent a notarized withdrawal request to the service center our case is handling.. we just sent it yesterday but ill tell my hubby to do what you did as well.. thank you.. :)

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hi! I've been posting questions about how long it takes to recieve a confirmation from the service center that the petition was withdrawn?my fiancé and I were advise to cancel before our petition got denied. So we were planning to cancel and then re-apply again. I will appreciate any response. thank you..
