Hello everyone.

I would like to seek your advise and opinions about my fiancee's case. He have filled the taxes with no issue for 2009 2010 2011. We are in the process of preparing the K1 application and is both confused. I have a question and I hope to get answers from this forum.

1. If we submit the application for K1 will the US embassy find out his tax issue on 2008 and will they deny our application?

Thank you so much and I hope to hear back from all the members.

What is his tax issue from 2008? Does he still owe taxes? If so, but he has made a payment plan, then it's no problem.

Hi Penguin_ie

Thanks for the reply.

He said that he is being asked to pay for $8000 but he has all the supporting documents that he is jobless at that time. He will not pay as he is still fighting for it. Do you suggest not to file the K1 until he get this tax issue settled? I have read that the US immigration only care about the federal taxes and not the state tax? Can i get some clarification on these.

File now- it will likely be sorted by the time your interview comes around anyway.
