I'm Japanese living in USA and have a girl friend in Moldova.

We have been dating online for a while.

We are planing to get US tourist visa for her for a while but It's not seceded yet. She was denied twice last summer.

I have visited her to Moldova last Christmas.

I was talking one of my Ukranian friends in NY about this situation.

My friend told me that in case of Moldavian passport holder, her passport shouldn't be blank in order to get USA visa.

In fact she had never traveled out side of former soviet union countries.

So this summer I took Japanese tourist visa for her and we had nice time for traveling in Japan. Now she had one stamp at Japan on her passport

Now Question is that can she ready to apply for USA visa? Should she visited some other countries?

Also my girl friend is saying an invitation letter for US visa should be from a US citizen or green card holder. Is it true?

I have been USA for 13years but i don't have green card yet. I have O visa instead.

My goal is that bring her to USA and merry her, and soon get her spouse visa, and apply green card together.

Please some one give advice. What is the best way.

If you aren't LPR or USC, you can't bring her to the US to stay. There aren't any visas for that.

You have to be a permanent resident or a US citizen.

She can come to you and get married, but it doesn't give her a right to stay in the US legally.

Or maybe she could get O-2 visa as your spouse after you get married.

Also I don't think it does matter how many stamps you have in your passport.

When I applied for my tourist visa, I didn't have any stamps and I got it.

I didn't have any invitation either.

What ties does she have to Moldova?

What was the reason/s she was denied last summer?

Has anything changed in her life situation since then?

What previous poster said + thinking that one stamp will change things because someone said that is a bit naive. First it is up to discretion of the immigration officer to decide and the decision will be based mostly on ties to her home country, second you are trying to commit a fraud using tourist visa for immigration.

And if you don't have permanent residency, how do you want your wife to obtain it ? Even if you get a green card now, there is 2-3 years wait for spouses of green card holders. Do some homework.

O2 would be the best option.

I think i should have confused with my line saying green card.

If I'm alone i thought i would apply green card soon thought my company.

However now I'm thinking to marry with her. When I talked my lawyer while ago, he told me that if I'm planing to marry her.

I should marry her first and get O2 visa for her. And then i should apply for green card later.

So this is my plan. Anyway this is my final goal.

She is not in USA at this point so I want to bring her somehow at the first place.

Probably with tourist visa(B2).

Questions I have right now are two.

She need a invitation letter in order to obtain B2 visa.

1. Can i write invitation letter for her?

I'm not American citizen nor Green card holder.

I heard invitation letter should be one from an American person.

2. dose it mutter how many stamps she has on her passport?

My friend told me more stamps on her passport is more chance to get tourist visa.

I guess US embassy is looking for applicants financial situation.

Give me some advice.

She does not need an invitation.

I guess more may be advantageous.

What proof did your girl friend show that she would leave the US after visiting and go home ? The weaker the proof the more she will be denied

She currently have a pretty good job and she has about 15k of saving at bank which is a lot for Moldovan.

I recommended to her to save money since last summer. I thought showing a pretty good amount bank statement proofs that she is not going to work at UAS and she will be back to Moldova.

This method at least worked when she applied for Japanese visa....

But maybe reason why she could have gotten Japanese visa was because I'm Japanese.

In fact only question she was asked during Japanese visa interview was "how she can proof I'm her friend". she showed a picture which I took with me, her and her parents together when I visited her Moldova.

What about switching her status from B2 to F1 in USA until we get marry in the worst case?

B2 is 6 months and F1 is several years. That's more than enough for we get marry.

Of course after marriage with me, She will be able to get O2 (Spouse visa) right?

And having O2 visa let her go out and come back to USA freely like me, right?

I know with all of above visas she cannot work legally but that's fine as long as she can stay USA legally.

And then we apply for green card tougher eventually.

First get your B visa which seems unlikely.

I think you answered your own question.

You want to bring her to the US and stay there permanently.

B visa is for being tourist, not for staying.

She will have to show her ties to Moldova, and prove (in the embassy) that she doesn't want to use B visa to immigrate to the US.

So far you're planning something completely different.

If you are planning on marrying her than you should do what your lawyer said, although I believe it's an O-3 visa you will be applying for, not an O-2.

If you want more time together before marriage then try for the B2 visa. She does not need an invitation letter, they are pretty much irrelevant. What she does need is to show strong ties to her home country. If she does get the B2, she will want to return before the 6 months is up, any overstay may hurt her chances for an O-3 visa in the future.
